Lincoln, July 18. (Special.) The
rumor that Attorney John Breen
of Omaha was to appeal to the
courts, in an effort to prevent the
holding of a session of the constitu
tional convention has caused con
siderable discussion.
Many are of the opinion that one
of the contentions of Mr. Breen
that the manner provided by the
legislature for'the election of dele
gates is unconstitutional finrJs con

are interested in the convention.

Opponents of the nonpartisan
plan of nomination and election
hold that there is no provision in the
election and primary law for the
nomination and election of candi
dates for the legislature on a non
partisan ballot, but that the law
especially provides for a partisan
ballot, therefore, in order to elect
members of the constitutional con
vention in "the same manner" as
those elected to the legislature there
must be a partisan ballot and a par
tisan election. They hol(L-ttat the
"same manner" means' just what it
says.
There is also sentiment growing
that Nebraska has chosen the worst
time in its history for the making
of a new constitution. The state
and whole country is in a state of
unrest. Strikes, profiteering, high
prices and the like, it is arguedj have
brought about prejudicial condi
tions that are liable to affect the elec
tion of "delegates to the convention
and the new constitution. They hold
that the state canot afford to have
a new constitution arattea under
any Dut tne Dest oi conditions rel
ative to the best interests of the
state without regard to any factional
difficulties.
Appeal $175 Judgment for
Missending of Telegram
Lincoln, July 18. The Western
Union Telegraph company has ap
pealed from a judgment secured in
the Merrick county district court by
James M. Kyle of Palmer.
Mr. Kyle sent a message ad
dressed to Clay Robinson & Co.,
National Stock Yards, 111., located
near St. Louis, ordering that firm
to ship him a carload of pigs. The
message was sent to Clay Robinson
& Co., National Stock Yards, Chi
cago. It is alleged by the plaintiff
that the pigs could' have been
bought in St. Louis at $11 per hun
dred, while the price paid for the
car sent him from Chicago was
$13.50 per hundred. He sued for
the difference and received a judg
ment for $175.63.
Assessed Valuation of
State Shows Big Increase
Lincoln, July 18. (Special).
According to Secretary Osborne of
the State Board of Equalization, 66
counties of the 93 in the state have
reported on the assessed valuation
of the counties, showing a total thus
far of $383,622,558 as against $382,
610,287 in the same counties last
year. Douglas county has not reported.
Admirers of Roosevelt
to Banquet in Lincoln
Lincoln, July 18. The Roosevelt
Memorial association of Nebraska,
will hold a banquet at the Lincoln
hotel in this city at 6 p. m. Thurs
day, July 31.
Gov. Henry J. Allen of Kansas
will be the principal speaker and
a general invitation to admirers of
the former president to attend the
banquet has been extended.
Treasurer's Report Shows
$571,354.60 in School Fund
Lincoln, July 18. The state ap
portionment of school tunds , as
shown by the report of State Treas
urer Cropsey to the state superin
tendent, shows a total of $571,354.60.
This is made up from the following:

Lease from school lands 173,592.45
Game and fish licenses 19,915.25
Miscellaneous licenses 40.560 29
State taxes 46.10
There was an overdraft caused by
an error in the last apportionment
amounting to $4,143. There are
6.904 districts to participate in the
distribution with a total of 382,975
pupils. ,
Members of Legislature
Will Retain Old Seats
Lincoln, July 187 Members of the
legislature will not have to apply
for reservation of seats for the spe
cial session as they will retain their
old places. Secretary of State Arhs
bury has had several applications
from members who appear to think
that it will be necessary to make ap
plication, i Members in both house
and senate will find their seats still
waiting for them, although the sena
tors will have to look in the supreme
court room for a place to occupy, as
the senate has- been pre-empted by
the good roads and automobile de
partments of the state engineer's
office.
President of Stromsburg
Bank Dies in Boulder, Colo.
Lincoln, July 18. Railway Com
missioner Victor E. Wilson received
a message from Boulder, Colo., that
his brother, J. W. Wilson, of
Stromsburg, had died.
Mr Wilson was president of the
First National bank "of Stromsburg
and it was principally due to his
incessant work in war activities that
he broke down and went to Colo
rads for his health. He came to Ne
braska in 1880 and has been one of
the leading factors in the building
up of Polk county. He was 53
years old. j
Permit Seneca Telephone
Co. to Raise Monthly Rate
Lincoln, July 18. The Seneca
Telephone company, with 26 sub
scribers and 18 stockholders, has
been granted permission by the
State Railway commission to make
a rate of $2.50 per house per month.
The line extends 43 miles through
the sand hills and is used almost
totally by ranchmen in that section.
Pioneer Leaves Wahoo.
Wahoo, Neb., July 1. (Special)
Members of the Congregational
church gave a farewell banquet for
Mr. and Mrs. G. A. Wenstrand, who
leave the first of August for Red
Oak, la., where they will make their
hoTne. They have lived in Saunders
county for 35 years.
Swine Bring Good Prices.
DeWitt, Neb., July 18. (Special.)
A combination sale of 160 cows
and spring and fall gilts held by
Duroc-Jersey breeders here was well
attended. Prices ranged from $30
to $200. The receipts of the sale
were more than $8,000.

Stella, Neb.,' July 18. (Special.)
Rev. J. Paul Reeves, who mysteri
ously disappeared in the winter of
1916, has been heard from in Cali
fornia. He was pastor of the Chris
tian church at Morrowville, Kan.,
at the time of his disappearance,
and was well known in Stella. He
had often filled the pulpit here as
his parents lived in Stella for a
while. His father was pastor of"
the Stella Christian church a year
or so ago, and moved from here to
Guide Rock. Now he lives at Pal
mer, Ne.
The young wife and two small
children of Rev. Mr. Reeves were
visiting at the home of his parents
at the time of his disappearance
and were cared for by friends and
relatives. They are now with Mrs.
Reeves' parents in Oklahoma.
The mother of Rev. J. Paul
Reeves has received a letter from
him stating that he suffered a lapse li
of memory and had just recovered I
from the affliction.
Kev. Mr. Keeves lett Morrowville
to spend the day at Washington,
Kan., and after starting back to
Morrowville ' mysteriously disap
peared.
He was last seen at or near Had
dam, Kan. It was during the heavy
winter snows and some thought he
had started to walk to his church in
the country and had fallen by the
roadside.' Previously he had com
plained of not feeling well.
No trace of him was found even
though the country there was care
fully searched. Detectives were em
ployed, but all search was of no
avail. Not until today, after a pe
riod ot three and one-halt years, was I?
any trace of him found. v
