The su preme court of the United States sustained today federal court de crees restraining the International News Service from piratirfg news of the Associated Press. Five mem bers, including Chief Justice White, concurred in a majority opinion de livered by Associate Justice Pitney upholding the principle of a prop erty right in news and the complaint of unfair competition, and refusing to interfere with injunctions. Associate Justice Brandeis dis sented entirely and Associate Justice Holmes delivered a brief opinion in which Associate Justice McKenna joined, holding that fraud on the part of the defendant in palming off the complainant's news as its own constituted the only ground of ac tion and that without legislation the only remedy to be applied was to grant an injunction requiring the International News to credit to the Associated Tress all pirated news used within , a certain number of hours after publication by Associ ated Vrcss papers. A. WELSH, Meteorologist - ..:..,--..,., - 18 62 ;n 42 13 38 1 33 16 45 in ; T On .nj t Paris, Dec, 23. The first column of the first page of the Matin, was censored yesterday. Only the head lines of the article were left. These read: "Yesterday's Utopia tomor row's realitv. Constitution of society of nations under serious consideration. Germany and her al lies will only be admitted if they accept principles on which entente governments shall have agreed." The Matin today was authorized to print the article which was cen sored yesterday. The article, the first headline of which read: "Yes terday's Utopia Tomorrow Real ity," sets forth the manner of pro cedure of the "promoters of a league of nations acting in agree ment with i the allied governments." The formation of a leagu of na tions, the article says, will be in 1 three stages. The allied govern- ments will decide the principles of such an organization, which will in- elude compulsory arbitration and limitation of armaments. Germany and her former allies will then be told that they must accept these principles, after which the treaty of peace will be formulated. Later, a conference will be held to discuss the formation of a league. Neutrals will be admitted, the article con tinues, but Girmanv would not have an equal standing until she had ex piated her misdeeds and before she can do so an international organiz tion will be working. In Three Stages. "There will be three stages," the Matin says. "First, the allied gov ernments will settle among them selves the principles of a league. As a fundamental rule they will set down the right of peoples to de cide their own destinies. As a prac tical consequence it follows that there will be limitation of arma ments and compulsory arbitration among the nations. It seems indis pensable that at this point the en tente countries bind themselves to put these clauses in the preliminaries of peace. "It has appeared absolutely nec essary to the promoters that the regime of the future world should be fixed in its main outlines before there are any questions of indem nities and territories, so that for the first time in history the deliber ations of the plenipotentiaries shguld be dominated by higher ideals than mere individual interest. "The second act will consist in notifying the enemy powers of the fundamental principles laid down in the preliminaries and requiring fro mthem their adhesion to these principles. As to other conditions of peace preliminaries, as in the case of stipulations of a territorial, finan cial and economic character, no disr Cussion will be admitted. The - tente delegates will say to Germany and its allies: , ; Compulsory Arbitration. " 'Compulsory arbitration and lim itation of armaments are integral parts of our conditions. You must subscribe, to them at once. You will know later how these principle;? will be applied.' "The preliminaries once signed, details of the peace treaty will bj: discussed among the belligerent and only after the signing of this treaty of this peace proper will thfe third stage be reached. This will be a universal conference to settlfc the new relations to be created bej tween the peoples. "To this conference neutrals majr be admitted. No nation, howeve. will be admitted to full membership in the league of nations if it doeji not offer sufficient guarantees. Gei many, having started the war, wijl have been condemned by the peace conference to make restitution f'JU. reparation. It cannot be regarded as being on an equal footing witli other nations until it has 'paid i$ debt. Germany has committed f crime and it must atone for it bar fore it can be admitted to th rankjs of honest and civilized peoplts. "Meanwhile the other countries will be united by formal agreement, a world police will have been cre ated and sanctions of all kinds will have been instituted. An interna tional tribunal will be working and the. specter of war, as far as it i humanly possible, will be banishejl from the path of civilization." j Dr. Blondheim to Head !
