ANTITRUST BASE BALL
SUIT HEARG1NG BEGUN
Goldman of Baltimore Federals
Claims League Agreement
Violated Sherman
Law.
Philadelphia, June 11. Testifying
today in the $900,000 suit of the Bal
timore federal league club against
Organized Base Ball growing out of
the peace agreement of directors in
1915, whereby the Federal league
went out of existence, L. Edwin Gold
man, a director of the Baltimore club,
said his club knew absolutely nothing
about negotiations to put the league
out of business until the peace agree
ment had been reached. He empha
sized his denial that the Baltimore
club was consulted in the negotiations.
The suit was brought under the
Sherman and Clayton anti-trust laws,
the Baltimore club charging that the
agreement between the Federal
league and Organized Base Ball was
a violation of the anti-trust laws and
tended to monopolize the base ball
business, the club also charges mat
the agreement disrupted, the Federal
league and that the club suffered dam
ages to the extent of $300,000, for
which, under the anti-trust laws, it is
ask ing triple damages.
Base isau rtot commercial.
George Wharton Pepper of counsel
for the big leagues, in his opening
statement, declared that base ball was
not a commercial business and did
not come within the federal anti-trust
laws. He also indicated there was no
attempt to monopolize base ball by
the major leagues, declaring that the
Deace agreement with the Federal
league was made necessary to end a
costly war and to restore public con
fidence in the management of the na
tional snort.
David L. Fultz. president of the
Players' fraternity, testified to the
operations of players' contracts, the
reserve clause and release clause when
court adjourned.
There was every evidence today
that the case would be bitterly
lougnr.
