Maltless
A BRANNEW BEVERAGE
Not a "near beer", or "temperance beer," not brewed, not fermented and
. dftes not contain malt, therefore the sale of it is hot a violation of the pro
hibition law, neither does the sal? of it violate the Constitutional Amendment.
In the case of Luther vs. State, 83 Neb. 55, our Supreme Court held (as
to the character of the liquor, it was not necessary to prove more than that it
was a Malt Liquor) the court said:
. ' "At any rate, the law prohibits the sale of Malt Liquors without a license,
and we must- obey its plain mandate..'' ' '
"Near beers" or "temperance beers" now on the market, containing malt
are a direct violation of the Constitutional Amendment, as the Constitutional
Amendment's wording is the same as the Slocum law, both prohibiting the
sale or barter of MALT, spirituous, vinous or other intoxicating liquors. The
last legislature passed House Roll No. 793, which prohibits the sale of any
brewed or fermented drinks, therefore, all dealers should insist that their job
bers furnish them with a written guarantee that any "near beer" or "temper
ance beer," which they purchase from the jobbers, is not BREWED or fer
mented and tnat it
A
is iii a class of its own, having a flavor and a taste of its own, and is not to be compared with any
"near beer" or "temperance' beer."
. Why sell "near beers" or "temperance beers," which are a direct violation of our prohibition laws,
when you can purchase "OMA," a brannew beverage, which complies with all the laws?

Three Millions.
Atlanta, Ga., May 22.-From 10,000
to 15,000 persons are homeless as a
result of yesterday's fire that swept
approximately seventy-five blocks of
residence property, causing a loss of
$3,500,000, it was estimated today.
Preparations have been made to feed
5,000 homeless.
The fire started in a warehouse on
Decatur and Fort streets and drove
first north and then northeast, at some
points a block wide and at times half
a mile in width. It was not checked
until beautiful homes had been de
stroyed by dynamite.
It crossed Ponce de Leon avenue
at one point and swept down the
boulevard for a block. On the south
side of Ponce de Leon avenue, wide
residence street, the burned area ex
tended from North Jackson street
some seven blocks east of Peachtree
street, the principal business section,
out almost to the base ball park.
