9 A CONVICTSSHOULD minds of the county boarders. Six papers are distributed daily and every : two or three days the sheriff hands! out eighteen new magazines maga- zines that are, at least, new to the I prisoner, thongh some of them are a few months old. As the reading class is an innovation introduced by the I sheriff on his own hook, he has to j buy the papers with money from his own pocket. Judge's Dictum. On the floor below the sheriff's of-1 fice is a judge who is of the opinion , that county jail prisoners should be j out making roads, exercising their ! UNDUE INFLUENCE ' CHARGED BY WIFE . Suit Filed in District Court In volves Estate Valued at Sixty Thousand Dollars. Ish had only a life estate therein, the fee simple title resting in the children. The petition states that on February 15. 1916, the plaintiffs executed and delivered to the trust company, as trustee for the benefit of the chil dren and the wife and mother, cer tain real estate belonging to the father. Ish alleges that by the terms of the will of his mother, the late Martha, C Ish, who left him the property in question, he was forbidden to sell, convey or mortgage any of it. The petition also asserts that the wife was forced to sign the trust deed by threats and' undue influence by the husband and that it was not her free and voluntary act It is alleged that "she protested until overcome by the stronger will of her husband, who threatened her with physical force." - (lira un YnndevUle. WANT TO KEEP STANDARDS Registered nurses and doctors all over Nebraska are up in arms over the introduction in the legislature of a bill to reduce the requirement of study and training for registered nurses. "The present requirements in Ne braska," said a member of a commit tee from the State Nurses' associa tion, "are one year of high school, at least, and three years' training in an accredited hospital before the candi date can take the state examination. These are the requirements in all other states, some even requiring four years' training. "The bill, introduced in the legisla ture by Dr. George Reneker of Falls City, makes no educational require ments at all and calls for only six months of training. "The efforts of an army of would be nurses to get certificates without adequate preparation are responsible for the bill now pending in the legis lature, known as house roll 230. "Passage of this bill would flood the state with a great number of in competent nurses which would be nothing less than a public menace. "Other states have congratulated Nebraska on the high standard at tained in nursing. This bill would destroy this standard and would mil itate against the proper nursing of the sick." Dr. Hoffineister, chairman of the State Medical commission, has re ceived a flood of letters from doc tors, nurses and others all over the state protesting ainst any such law as is proposed in' the bill. Wild Horse Men Ask for New Trial On Ground of Error That the court erred in refusing to direct the jury to bring in a verdict of not guilty at the close of the "wild horse" case 's one of the sixteen rea sons set forth in a motion for a new trial by attorneys for J. Sidney Smith, C A. Smith, B. F. Burwinkle and William Hinkley, found guilty for using the mails to defraud in selling wild and imaginary horses on the government reserve in Coconino county Arizona. Further grounds set forth m the petition are that the jury was biased because of reading newspapers and because of the prejudice of Juror Ben Gallagher. -.1: BUILD THE ROXDS Judge Troop Disputes Sheriff Clark's Theory of Feeding Literature to Prisoners. PRACTICAL PENAL SCHEME ALLEGE ILLEGAL TRANSFER Sheriff Clark, self-appointed board f censorship of one, of newspa, ers and magazines that are daily distrib uted among the prisoners in the county jail under the new regime, believes that the members of the reading class break the monotony rach day about six hours' worth, any way. Each morning the sheriff oper ates on the morning papers and puts the scissors to all items of crime and lawlessness that might inflame the A deed of trust of real estate valued at $60,000 is involved in a suit brought in district court by James C. Ish and his wife, .Anna M. Ish, against the First Trust company of Omaha and Leah M. Ml, Lois F. Ish, James K. Ish and Lusy G. Ish, minor children of the plaintiffs. It is set forth by the defendants that the complainants had no right to convey by deed of trust certain muscles on the rock pile or some thing of the sort. Judge Troup rec commends legislation that will allow counties to work prisoners on some thing which will bring in some money. The money derived from the toil of husky, healthy county jail prisoners could fittingly be used to help pay the expenses of the poor farm, county hospital and other institutions, where the inmates are upable to do much physical labor, the judge asserts. real estate by reason that James hla skill In billiard rooms. fHE OMAHA SUNDAY BEE: JANUARY 28, 1917.
