Wants Big Damages for
The Loss of His Big Toe
For one big toe $20,000.
That's what Beniamin Greenlaw,
farmhand, figures that Guy L. Axtell,
farmer at Gilmore, owes him for the
loss of the member under extenuating
circumstances while employed by the
husbandman on All roots day, ivit.
According to suit filed against Mr.
Axtell by Montgomery, Hall &
Young for Greenlaw, the plaintiff was
ordered to remove a woven wire fence
on the farm and while engaged in
rarrvinar out the orders of the farm
foreman stepped on a rusty nan pro
truding from a board alongside the
tence.
More trouble arose when Greenlaw
was taken to the farm house and the
wound seared with turpentine, in
jected with a syringe that had been
used for squirting serum into hogs as
an antidote against disease. Further
infection was caused and the amputa
tion of the great toe was necessary to
prevent further poisoning of the
blood, n,
Greenlaw was taken to the county
hos-pital at the poor farm and doctors
afterward clipped more chunks of toe
from his foot. The farm hand de-
Vclares he has been incapacitated and
;liat he is now Unable to work.
Forty Appeal Cases Are
Up Before Judge Sears
Forty cases, appealed from the po
lice1 and justice courts, charging de
fendants with a variety of offenses
kept the wheels of Judge W.
G. Sears' court grinding. The ma
jority pf the defendants failed
to anoear. bonds were ordered for-N
feited and new warrants issued. City
ProsecutoA Maguire is handling the
cases for the municipality.
HADSER MAY GET ?
ONE MORE CHANCE
Application for New Trial Will
be Forwarded to Supreme "
Court This Week.
ALLEGES ERRORS BY SEASS
Arthur Hauser, convicted of man
slaughter for the killing of William
H. Smith, cashier of the Woodmen
of the World, on October 16,' 195,
may have one last chance to secure
his liberty, or a reduction of his sen
tence. Hauser Is now serving a life
sentence at the state penitentiary.
Public Defender Richard A. Horton
is completing the preparation of a
lengthy transcript of evidence show
ing that errors were committed when
Judge Willis G. Sears, who heard the
case following the death of Judge
English, refused to grant change ot
venue because of prejudice against
Hauser in Douglas county.
More than 100 instances of where
alleged errors crept into the handling
of the case are set forth in the appli
cation for new trial
This is the first instance of a test
in Nebraska to prove that the death
of the trial judge demands that the
defendant be given a new trial. Pub
lic Defender Horton maintains that
the laws of most states require that
thirteen men hear the evidence
twelve jurors and the judge, and that
the situation in the Hauser case was
similar. He asserts that the death
of Judge English during the trial
automatically granted a new hearing
to Hauser. The motion was denied
by Presiding Judge Sears, who sen
tenced Hauser to spend the remainder
of his days in the state penitentiary.
Fined for Having Wild
Ducks in Their Bags
Fred Matz, 1807 Cass street, and
John Thurmeir, .1701 Davenport, paid
heavy for a little duck shooting they
did in Iowa Wednesday. They re
turned on the street car and met
Game Warden J. W. Gilmore, who
confiscated the ducks and arrested the
men. Warden Gilmcfre took a change
of venue to Justice Britt's court and
the men were fined $10 each.
