More trouble arose when Greenlaw was taken to the farm house and the wound seared with turpentine, in jected with a syringe that had been used for squirting serum into hogs as an antidote against disease. ALLEGES ERRORS BY SEASS Arthur Hauser, convicted of man slaughter for the killing of William H. Smith, cashier of the Woodmen of the World, on October 16,' 195, may have one last chance to secure his liberty, or a reduction of his sen tence. Hauser Is now serving a life sentence at the state penitentiary. Public Defender Richard A. Horton is completing the preparation of a lengthy transcript of evidence show ing that errors were committed when Judge Willis G. Sears, who heard the case following the death of Judge English, refused to grant change ot venue because of prejudice against Hauser in Douglas county. More than 100 instances of where alleged errors crept into the handling of the case are set forth in the appli cation for new trial This is the first instance of a test in Nebraska to prove that the death of the trial judge demands that the defendant be given a new trial. Pub lic Defender Horton maintains that the laws of most states require that thirteen men hear the evidence twelve jurors and the judge, and that the situation in the Hauser case was similar. He asserts that the death of Judge English during the trial automatically granted a new hearing to Hauser. The motion was denied by Presiding Judge Sears, who sen tenced Hauser to spend the remainder of his days in the state penitentiary.
