market was preity dull and declined fr-m

ST. FRANCIS' ACADEMY
IS SOLD TO THE CHURCH
All of the lots comprising the property
of Ht. Fran eta academy were sold yes
terday by Its owners, the Bisters of
Charity, to the parish of 8t Francis
Xavler Cathollo church. The school
property adjoins the church and Is really
part of the church and parish grounds.
The sale wag mads by D. Mahar of
Iowa City, representing the sisters. Mr.
Mahar to the father of Mrs. Hubert U
Tinier. Rev. Father McMsnus of tha
church. Emmet Tlnley and II A. Wick-
ham represented tha parish. Tha consid
eration was 830,000. Immediately after
the sale was negotiated Mr. Mahar an
nounced that he was authorised to re
mit 810.000 of the purchase price of the
property by Instructions from the mother
general of the Sisters of Charity.
The property has been used for many
years as an academy for girls and Bt.
Francis acadsmy has been one of the
iibted educational Institutions of the
western part of the state. Recently the
school was removed.
It Is understood that the property is
now to be used by the Catholic school
for boys, Su Joseph's academy, which
has practically outgrown I la old quarters
on tha east side of South Sixth street,
and whsre a fine new building was built
last year. The new grounds and build

As has been the case every day this
week packers at first refused to follow
the shipper advance, but wore again
forced to do so. and In the end the bulk

Seven Indictments
By U, S. Grand Jury
Seven lndlotment ware returned yes
terday by the federal court grand Jury
after only a day's work. The report wag
made yesterday and tho Jurors returned
to their task. Five of the persons In
dicted were under arrest and the Indlct
tnsntg were made public All of tho five
were arraigned before Judge Wade and
four of them entered pleas of guilty.
Oeorga Plntsler, accused of a violation
of the Mann white slave get, waa Indicted
on two counts and entered a plea of
gtiilty to one, receiving a sentence of two
years In the federal penltettlary at Fort
Leavonworth. plntsler Is accused of
transporting- Kthsl Redfern from Ot
tumwa to Omaha for Immoral purposes.
Henry Ward. Thomas Murphy and Paul
Trask, Indicted for having In their pos
session and selling opium, cocoa leaves
and morphine, entered a plea of guilty to
bavins the goods In their possession, and
the other charge was dismissed by Dis
trict Attorney Porter. The men were
sentenced . to five month each In the
county Jail, dating from their arrest by
the pollcg last May, so they will be re
leased In about three weeks mors.
W. D. flchermerhorn, alias William De
Forest, was Indicted under the white
slave law for bringing Mrs. Esther Osnts
from rreeport. 111., to Council Bluffs.
They were followed by Mrs. Osnts1 hug
band, who came here after receiving an
earnest appeal from his wife to be for
given. Scliermerhorn and the woman
were In Jail when he arrived and had a
meeting In the office ot United States
Commissioner spencer Smith, at which a
full reconciliation took place. Osnts and
his wife left on an afternoon train to re
turn to their family of half a doisn
mall children. Schermerhorn waa left
to face the musio alon. Ho ha deter
mined to fight the case despite over
whelming evidence.

Charge Filed Against
Miss Julia Officer
An Information was fllad In police
court yesterday morning by Sanitary Of
ficer liendrlx accusing Miss Julia Officer
with maintaining a nuisance at her home,
1j0 Fifth avenue.
It was charged that a numbsr of chick
ens kept la pens were not properly cared
for, thst ths pens were unsanitary and
detrimental to the near neighbors.
The complaint was filed after a con
ference with City Solicitor Schneider, who
drew up the Information for the sanitary
officer to sign. Miss Officer wss not
compelled to appear In police court. At
the request of the city solicitor the case
was continued until Saturday. She has
retained attorneys who will defend her
when required.
