Mrs. Thaw Refuses ;
to Honor Subpoena

Mt Thaw haa refused to honor the sub
poena served On her yesterday summon
ing her to Nw York to testify at the
proceeding to determine the sanity of
her husband, Harry K. Thaw.
Mrs. Thaw, it became known today, told
William McGulre, the state's process
server, that she was in poor health and
feared for her life should -she be com
pelled to undergo the ordeal on the wit
ness stand to which aha thought she
would be subjected in cross-examination
bv Thaw's counsel.
She said that aha would furnish a doc
tor's certificate If required to do so by
the court.' '
Thaw refuses to obey the subpoena sum
moning her to testify as a state's wit
ness at tha trial to test her husband's
sanity, as. reported from Malono, N." Y.,
th attorney general's of Ice will apply
to tho court for a body writ of attach
ment to compel her attendance. Her ex
cuse that the strain of appearing on tha
stand would endanger her health, will
not bo considered. It was said, unleaa put

opened here today at tha Buffalo ounty
fair tracks. l.OOn people witnessing the
opening races. Despite rainy weather the
track was in excellent condition, having
been worked steadily all day, until time
for the races. Some good time was
mad by the horses entered in the har
ness races today, while faster horses will
be seen on July 2 and 3.
One hundred and thlrly-two horses and
thirty running horses are entered in th
meet. The track was probably two sec
onds slower today than under favorablo
conditions and there Is little doubt but
the time could have been clipped a trlfla
by the winners but for tha heaviness
of the prround.
The State Industrial school band of
