late Stephen D. Bangs, Omaba pio
neer and capitalist, which divided a
quarter of a million dollars among
Omaha charitable institutions and
members of the family of the late
Hichard S. Mall, his stepson, would
be sustained., was made from the
bench by County Jtylge Crawford
after all the evidence in the content
case had been presented.
A request by ettomeys for Gilbert M.
Banes of New York and George H. Bangs
of Wayne, the contestants, who claim to
be second cousins of the deceased, that
decision by the court be postponed In
order to allow further argument of a
law point Involved was granted. Judge
Crawford, however. Indicated his belief
that a supreme court decision required
tiltn to uphold the will. '
The point Involved grew'out of testtl-
mony by Dr. Alfred S. Mattson and Mins
Nettle Budler, a nurse, witnesses of the
will, that they were not specifically no
tified ef the nature' of the document to
which they signed their names.
The following bequests to charitable In
stitutions are Involved In the suit: Trin
