Appeals Court Judge
Asks if Federals
Knew of Reserve
CINCINNATI. O., June 10. "It we per
mit one team to seize upon players or
another without regard to moral or legal
obligation, wo are going to undermine
tho whole structure of base ball and the
game will lose Its hold on the public"
This was the sentiment expressed today
by Attorney George W. Pepper of Phila
delphia, representing William M. KlUlfer.
Ir.. catcher with the Philadelphia Na
tionals, and the owners of the team.
when he stood before the United States
circuit court of appeals and opposed the
plea for an injunction to prevent KlUlfer
from playing with the Philadelphia club
made by the owners of the Chicago Fed
eral league club.
Attorney E. E. Gates, representing the
Chicago Federals, made 'the first argu
ment. He said KlUlfer told President
Gllmore and other officers of the Federal
league he was free to make a contract for
his services and waa not In any manner
bound to the Philadelphia, Nationals.
Judge Denlson pit the question: "Did
not the owners of the Federal league club
know of the reserve clause In KUlfer's
contract!'
Attorney Gates replied: "Even If they
had knowledge of it. It was only general
knowledge and they still would have the
right to offer work to KlUlfer, Inasmuch
ns he had told them he was not under
contract to anyone else."
Silas Strawn of Chicago also spoke in
behalf of the Chicago Federals.
At the conclusion of the arguments the
judges announced they would take the
case under consideration and would hand
down a decision later,
Clarke's Kick on Uinpa.
Fred Clarke Is not In favor of umpires
alternating behind the bat and on the
bases. He says they should stay In one
rlace. "Why. argues Clarke. "It's lust
like switching a. shortstop and -first base
man. Umpires are rotten enough, and
they ned to stay In one poslUon all the
j urn in oraer to get tne practice."

Words of Wisdom.
Charley Williams, former business man
ager of the Cubs, declares on his honor
that the talkative expresldent of the Cubs
Is still In power. "I do not question tha
veracity of Mr. Tener or Johnson," said
Williams the other day. "They oay that
Murphy has turned over his stock to
Taft No doubt Mr. Taft showed Gov
ernor Tener such a transfer. But that,
none the less, does not prevent Murphy
from controlling the club. He Is the
power behind the throne, all right."
