automobile smash-up In St. Paul. They
were Joy. riding when their machine got
away from them and collided with an
Iron telephone or light pole. The ma
chine was split In two and the men all
bndly hurt.
(lonit Karnur to Hue.
That was as good an excuse to sue a
railroad as one lawyer wanted. Ho nailed
his man and tcRethcr they made out their
case. This case was tried nt St, Paul
late In April of this year. The railroad
won only after as desperate a fight as If
the case had actually been bona fide, nnd
when the verdict of the Jury was tele
phoned Into the railroad's legal offices
Its attorneys who hnd fought It through
were as Jubilant as If they had actually
aohloved a signal victory.
This man swore on the stand, under his
lawyer's direction, that his Injury came
from the accident at Mackenzie, N. D
two years before; that at that time he
wan so badly hurt as to bo unable to
travel and laid In bed at Fargo seven
days. Tho railroad produced the book's
of the company for which this fellow had
worked to show that he never lost a day;
that Instead of being laid up for seven
days Immediately following the accident,
ho mndo five towns the very next day.
The man sworu that he had been earning
on tho road from JIM to IM0 a month.
Tho company's books showed that the
most he ever earned was H"(t a month for
only one month and that his highest an
nual Income was 11,400, nnd that this was
earned In the year following his alleged
Injury nt Mackenzie.
Yet when this case went to the Jury
after a severe trial the Jury baltotcd sev
eral times before reaching a conclusion
In favor of the company. The plaintiff's
attorney In this case was Tautgess of the
firm of Hall. Tautgess &. Loefflcr of Min
neapolis. Poor I,nirrrri Ilnrrrd.
This Is no bualness for a poor lawyer
or a young one Just starting Into prac
tice, unless he can get In with one 'vhi
has tho money. For It takes money to
play this game. It requires an Immense
amount for advertising under cover
soliciting nnd maintaining agenta. Be
sides, some of the more successful prac
titioners, such as "BUI" Keefo of 8t.
Paul, who thodgh not a lawyer Is t
pioneer at tho business, with 8. Ander
son aa his chief lawyer! Stiles &. Devaney
of Minneapolis nnd others, have their
own "homes," or hospitals, whore their
patlenta or clients are kept, it la much
safer to keep a client at one's own hos
pital where he knows all that goes on.
Tho railroad's profess to have a record
of a caso where one of these clients with
a broken arm wan kept at a hospital for
thirteen days before anything was done to
rellova his injur?. The worse the Injury
tho better the chance for damages.
Then another sourso of expense Is thu
payment of contingencies and the pur
chase of claims. These lawyer very fre
quently so to an Injured person and
guarantee him any amount he Is offend
by tho company In a proposed settle
ment, simply buying the man'a claim.
They also pay as high as J100 a month
contingency pending the trial. This Alt
take money. This Is ono reason why the
Industry Is monopolized by a handful of
lawyers.
One of tho most resqurceful of these
personal Injury expert" l W. R. Dux
bury of St. Paul, who served many years
as & railroad lawyer.
1.1st of Ifixhlblta.
Here Is "the enclosed schedule of re
cent cases" Mr. Duxbury sends. The case
of Burlio against the Minneapolis and St.
Louis Railroad, with a verdict of $25,7(0,
was, according to the, railroad's lawyers,
finally settled at Washington, D. -'.,
pending appeal, .for less than the amount
stated. This ti a sample list, which seems
to verify the statement made In contra
diction to the personal Injury lawyers that
the average Judgment In Minnesota Is
not greater than lstwhere:

In these Instances we recovered four times tho amounts offered In settlement
to our clients before we took charge of the cases, and settled forty-one out of
forty-nine, without the expense of going Into court.
Denied by Railroad.
The railroads not only emphatically
deny this lost statement, but go on to
show that, counting for the amount paid
the lawyers and the loss of employment
to those who might have It from the
roads, the claimant come out of the ma
jority of cases 1n Minnesota very much
worse oft than bad they settled direct
with the companies.
According to the railroads these sample
lists are not so arranged as to reflect all
the little details. For Instance, they do
not always disclose Just how the spoils
were divided as between the lawyer and
his client. One of the trick of the trade,
so the railroads say, la for tho personal
Injury lawyer to drag a "settlement" or
suit along as long as possible and the re
sult generally Is a big amount of fee
and "expenses" to counterbalance what
ever tho client Is supposed to get.
This much seems plain these lawyer
are In this unusual game, not for their
health, nor that of the claimant against
a railroad, but for their own financial
enrichment. .
