'The petition also asks that the ordinance be decreed unconstitu tional, null and void. The petition In equity declares tlrat the power of regulation of rates M common carriers Is held expressly by the State Railway commission and that the city hi no power to pass legislation affect' liitr the rates of the street railway com pany here. It Is further alleged that- the referen dum and Initiative statute Is null and void oh the ground' th'at Uio constltutjon does not give the legislature authority to grant such power to the city, to the tnaydr and council, or to the voter's of the city Attacks the .Petitions.
