Foell, who also restrained the Kansas

contract with the Cincinnati National

(Hans) Wagner. Pittsburgh, was today
ppolnted a member of the State Fish
commission to succeed Henry C. Cox, re
signed. Wagner Is the shortstop of the
Pittsburgh National league base ball
team and Is Interested In angling and
fish propagation.
Postmasters Not
Eesponsible for
Money Stolen
SIOUX FALLS, S. D April 23.-(8pe
clal.)-Judge Elliot, of the United States
court, has rendered a decision holding
that the United States government can
not recover from P. J. Rodge, post
master of Sioux Falls, the value of i
310,000 package of money which was con
signed to a Sioux Falls bank and which
mysteriously disappeared from the lo
cat postofflce about two years ago,
Judge Elliot held In substance that there
was no liability on the part of the post
master unless negligence was shown
and that nothing of the kind had been
shown In this case.
The cause was instituted as a test and
In the hope that if postmasters could
be held liable in such cases, the Insur
ance companies which Insure money
transmitted through the malls which is
stolen can recover from the postmaster
from whose office the money diss
ppeared. This Is the first case of tho
kind ever Instituted In the United States,
and the decision of Judge ElKoOUl not
be pleasing to the Insurance companies
which make a business of Insuring
money sent by mall, but will . e welcome
to all postmasters throughout the union
who may at any time have valuable
money packages disappear from their
postofflces.
Whether or not the case will be ap
pealed to a higher court has not been-
announced.

Mrs, Park Shurlock, after several weeks
of suffering, died at her home In the
west part of town at about S o'clock
Tuesday evening. The deceased was In
her seventieth year and was one of the
early settlers In York county. She leave
one son and one daughter, her husband
having preceded her some fourteen year
ago, besides several grandchildren.

MASON CITY George Douglass was
placed under arrest on Information filed
by Mrs. Alice Wright charging him with
arson. She tells the story that Douglass
wanted to marry her and sho refused and
for revenge he set fire to nor home. It
Is alleged that there was evidence of
kerosene being poured over clothing In
the bed room where the fire as dls
covered. By prompt action the fire was
put out before much damage was done.

Weaver, who died last week at Waverly.
