Hammond Gets New
Ruling on Income
Tax Law Provisions
Itoss ti. Hammond, collector of inter
nal revenue for the district of Nebraska,
has received the following new ruling
from tho department, sltmed bv Commla.
sloner W. II. Osborn, in regard to the
administration of tho new Income tax
law:
Ueferrlng to paragraph 13, section 2
of the Income tax law, which reads as
follows:
"That In computing net Income thero
shall bo excluded interest upon the obli
gations of a stato or any political sub
division thereof,"
you are Informed that under date of
January SO, 19H, the honorable, the at
torney general, held that special assess
ment districts created under tho laws
of the several states for public purposes,
such as the Improvement of streets and
public highways, the provision for sew
erage, gas and light, and the reclama
tion, drainage or Irrigation of bodies of
land within such special assessment dis
tricts, when such districts aro for public
use, are political subdivisions of the
stato within the meaning of the above
proviso.
lt. !8 h.el.d that tl,e teTm "Political sub.
division" includes special assessment dis
tricts or divisions of a state created by
the proper authority of the state acting
within Its constitutional powers and un
der Its general laws, for the purpose of
carrying out a portion of those, func
tions of the state, which by long usage
and inherent necessities of government
have always been regarded as public.
Levee and school districts, when law
fully created under the authority of tho
state and which fare authorized by the
laws of the state to levy a tax to meet
the obligations of such districts, are also
held to be political subdivisions of a
state within the meaning of the income
tux 1aw
The Income derived from Interest upon
the obligations of all such public dis
tricts shall, therefore, be excluded In
computing net Income for the lncoma tax.
