November So. 1511 From tho present outlook nothing short of war will help the wheat bulls out of their presentKhdldlngs. lrt tho fnco of the present situation In tho Balkans. Russia, Is offering -Its wheat In Increased quanti ties Rnd. growers thero are willing to meet the views ot buyers In order to place at least a part ot the grain that Is now available and for wlilch the sole Is quite slow. Russian holdor fear the Argentine will como to the front with Its usual rush of receipts of new wheat and that the southern hemisphere growers will force their Brain upon the markets of the world, nnd thut In order to dispose of a portion or their surplus, Russia will bo found to cut the price at which Argon tlna has disposed a goodly portion ot Its grain. In our own northwest the re ceipts are certain to continue right up j until they are partially cut oft by stormy t weathtr and tho stocks then aro likely , to groiv larger and larKor. It may be ruld that Canada Is turning every stone In ' order to get rid of a part of the wheat now held in -that country. The situation of Buffalo could hardly be moro discour aging to tho holders than at the present. The harbor there Is ns tight ns a drum because ot so many boatloads of wheat held there and thero Is no holp for this condition until next spring, when the rail roads are Riven tho grain to haul to tho seaboard tor expert. NHW YOIIK, Nov. 30.-Th'e recent strain upon tho resources of the New York banks waa reflected In a striking way In today's bank stalomont. Not only was last week's slender surplus reserve of W,7C5,000 obliterated, but at the close of the banking week, aa shown In the actual tablo, there was a deficit of 86,037. 000. The cash loss reached a total of lli, W2,O0O, an amount ffreatly In excess of all forecasts, the most unfavorable of which did not suRgest a shrinkage of more than JIO.000,060. Tlie decrease In tbo aggregate cash reserve was 111, 823,0)0. It Is expected that the position of the banks will be lamely reclined within, a comparatively short time. For the week the receipts foot- up 15,425 head, being a falling off of 14,000 head as compared with last week, but larger than a year ago by over 3,000 head. The supply of desirable steers was very moderate throughout the week, and as there was & good buying demand prices gradually strengthened up until at tho close of tho Week the market Is right 'around 2uo higher than It was a week ago. This Is true ot good westerns as well as of cornfeds. Cdwa and heifers wero active sellers all the wek and they, too, have shown about the same advance as beef steers, being generally 25c higher than last week. The market as a whole has been In very satis factory condition, trade being active. V The supply of stock cattle ond feeders throughout the week was at no time very large, but still the IntarVcntlon of ft holi day naturally kept a ood many would-be buyers at home. Still the market has steadily firmed tip and at the closo of the week Is 23c higher than last week. The speculators bought conserva tively, thus leuvlng the big bulk of a liberal supply at the mercy of the pack ing Interests. The packer buyers filled a few of their orders at about opening prices, but this did not last long, as they found as the morning advanced that they could get their hogs at a lower cost. The first purchases ot the packers and the speculators were made around J7.707.75, and at J7.S0 top for the day, which was paid for a few good loads. A little later in tho mordning tho packers resorted t6" their bearish tactics and In the end the bulk of Uie packers' droves was picked tip at figures around J7.CO(S7.70. Today's trade differed from yesterday's market In that prices became lower towards the close instead ot getting better, closing values showing practically all tho early advance lost. On the whole the movement was fairly active and the pens were fairly well cleared in very good season. Re ceipts for the day foot Up In tho neigh borhood of 133 cars or 9,330 head, as com pared with 7,716 head last Baturday, 6,498 head two weeks ago and 6,748 head on the samo day a year ago. One of the outstanding features ot this week's trade has been a marked falling off In the receipts as compared with the previous week and the same time two weeks ago. Tho supply, however, was considerably larger than for the corres pondlng week a year ago. Chiefly under the Influence of a very meager supply of decent killers the fat lamb and sheep trade was active on most days and values have shown a substantial advance over the close of last week. All this Improve ment In tho local trade has taken place In spite of tho fact that the eastern trade In dressed mutton has shown weakness and some uncertainty during the greater part of the week. Closing quotations on fat lambs aro fully 2.V40c higher than a week ago. with tho best fed wetern lambs on Friday's market selling readily at J7.05 as against J7.2& on Monday. Really prime lamos were exceptionally scarce on most days of the week and sold nt the high est point yesterday. Partially In sympa thy with lnmbs, prime handywelght yearlings have also shown considerable Improvement, tho advance on them amounting to fully half a dollar A double deck of the best fed yearlings reached to. .z yesieruuy, cumpuieu wmi during the previous week. When consid ering tho size of the receipts thero was a very creditable showing of fat ewes and wethers, ewes being on the market In tho largest numbers. Both killing owes and wethers aro a good strong quarter higher than the close of last week, mnatlv evervthlne nf thut class meeting with a ready sale. The highest price paid ror iai ewes was i.su, wane nciuen commanded, as much as J4.C5. The feeder lamb and sheep trade has been active and while there has been some change in prices oh lambs, very little, If any, Improvement Is noticeable on sheep. The market on the general run of lamb offerings may be regarded as about 1015o better than prices prevailing at tho nd of last week. The grades of feeder lambs weighing from 50 to 60 pounds sold up to Jfl.65, while the bulk of tho good ones were cleared at figures around Jfl.406.50. There continues to be a good demand for both desirable feeder sheep and lambs, and there Is a strong undertone to current prices. Quotations on Sheep and lambs Lambs, good to- choice. Tho testimony of,tho complalnnnt its to tho commission of tho crime by the de fendant may be corroborated by evidence of facts and circumstances showing a uisposuion on his part to commit the crime and an opportunity to do so. 3. If the crime Itself Is established be yond question, nnd there are inconsisten cies In the evidence ot the defendant, as to material matters, from which It may reasonably bo inferred that the testimony of the complaining witness Implicating tho defendant Is substantially correct, It pre sents a case tor tho Jury under suitable Instructions. 4. It Is the testimony of the prosecuting witness as to tho guilt ot the defendant that must be corroborated. When thero is evidence tending to prove several dis tinct crimes, nnd the prosecution has elected upon which to proceed, n requcrt to Instruct tho Jury that defendant must be acquitted "unless you find from the evidence, beyond a reiusonabto doubt, that the defendant 'committed tho act so elected nnd as to this net you cannot find tho defendant guilty on tho evidence of Mary Waddick alone, us to the act she must be corroborated by testimony other than her own" was properly re fused, for although this language might be considered n correct technical state ment, still in the connection asked the language might bp misleading to the Jury. 5. When upon the trial there Is ovldonce tending to prove several distinct crimes and thd prosecution has been required to select upon. which It will proceed, the court shouldf so Instruct the Jury In the submission of the cose. It Is erroneous under such circumstances to Instruct the Jury: "Vou are Instructed that If you should find from tho evidence beyond a reasonaule doubt thut any act ot sexual Intercourse did take place between tho de fendant and said Mary Wnddlck and that nt the time of said Intercourse the said Mury Waddick was under the ago ot 15 years, thn you should find tho defendunt guilty us charged In the Indictment.
