SAN FRANCISCO, Oct 4.-Nrither by
nomination as republican! nor by petition
as independents, can electors pledged .to
President Taft go on the November ballot
In California.
The first possibility was closed today
by the decision of the supreme court, the
second bad deliberately been neglected.
There is some talk among Taft men
that at a meeting of the state executive
committee to be held next Saturday, they
may decide to contest th constitutionality
of the state-primary law, which was not
at issue today. ,
In a decision excoriating th state
primary law as like none other in the
United States, Chief Justice Beatty,
speaking the unanimous mind of his as
sociates, today declared that nevertheless,
under the law such, as it Is, th duty of
the court was to declare that the con
vontlon at Sarcramento, which by a vote
of 88 to 18 nominated electors pledged to
Roosevelt and Johnson, was the only
called and legally constituted republican
convention of this state and that Its
nominees were the nominees in California
of the republican party.
, It was declared by Taft campaign man
agers tonight that , to take the last re
course remaining to - them, an attack
upon the constitutionality of the state
primary law, would be "playing into the
hands of Roosevelt" ,
It was pointed out thai a decision in
validating the primary law probably
would have the effect of invalidating the
November election also, in which case
the legislators could be convened in extra
session to appoint presidential electors.
As the progressive republican faction is
largely in the majority In the legislature,
it was assumed that it would select
electors pledged to Roosevelt
Edward I. Wolfe, chairman of the recent
Taft republican state convention, was
authority for the statement that no
further attempt would be made to obtain
representation on the November ballot
