Howell of ths Omaha Water board, had wrangled before the Board of County Commissioners for two hours yesterday on ths matter of ths company's application for a refund of th S3.0M tax assessment It bad paid, th board took th advice of County Attorney James P. English and Deputy County Attorney A. O. Elllck and Indefinitely deferred action yesterday afternoon. Stout renewed his plea that the P6.000 tax, paid on the assessment against the company's K, 334,000 Judgment, was paid by error and should be refunded because County and City Treasurer Ure has or dered the sheriff to serv a distress war rant to satisfy a 135,000 assessment against th physical property of ths com pany. Should ths SX.0D0 assessment be collected and th 1000 be refunded It would be a case of double taxation, said Stout Howell contended that both taxes should bs collected, with th understanding that when th, courts finally havs determined whether th eompany owns a water plant or a Judgment against th city on tax or th other will be refunded. Th meeting was enlivened by ex changes of.unpleasantrles by Stout and Howell, Stout having th better of It Stout accused Howell and th water board of spending 100,000 of th city's money trying to keep from taking the water plant, called Howell the monitor of th Board of County Commissioners and re ferred to several of Howell's statements as "truck." Howell retorted by saying the attorneys for ths water eompany were getting hundreds 'of" thousands of dollars out of ths fight, and when Stout denied this, said that shortly before he died the lat Richard Hall, then attor ney for th water company, said hi tees would amount to near a quarter of a million. E. J. GREEN, WELL KNOWN TRAVELING MAN, IS DEAD E. J. Green, for twenty-five years a resident of Omaha and during much of this time Identified with th traveling men of Nebraska, died last night at the Presbyterian hospital, where he had re cently undergone an operation tor stomach trouble. Mr. Green several years ago underwent s similar operation and re gained his health, but on a recurrence of ths disease he was unable to withstand ths heroic treatment that was found necessary. For fifteen years Mr. Green held a prominent position on ths sales fore of ths Cudahy Packing eompany. Ha wss a member of ths Greens-Forbes Construc tion company that built th Young Wom en's Chrtstlsn association building and at th time of his death wss a member of the grocery firm of Green t Gillespie. He was past oounselor of Omaha council. United Commercial Travelers, and was secretary of ths council at ths time of his death. H was a member of ths E3ks and Knights of Columbus. Besides his widow, three children sur vive Mr. Green, residing at MS Georgia avenue. Th funeral arrangements will be mad later. Union council No. Hi, United Commer cial Travelers, had planned to hold a big meeting tonight at Myrtle hall, but because of th sudden death of Mr, Oreen this has been Indefinitely postponed by order of J. H. Sinclair, senior counselor, and Henry Rob. Iff, chairman of th execu tive board. Pool Still in Race For Governorship Charles W. Pool insists ho Is stilt In the race for governor of Nebraska, and that he has not withdrawn from the demo cratic primary ticket. In a letter to Th Bee. Mr. Pool was reported as having been pulled off at the Harmon and Har mony meeting of democrats at Fremont last Monday, but hs says no steps have been takes with that object In view and, having paid his filing fee, he Is tn the running.
