A hesr ng Involving coal rates between nearly a hundred Colorado points and the same number of towns in this state was held at l he federal court room In this city today before Special Examiner J. E. Smith of the Interstate Commerce commission. In which the Uurlington, the Colorado & Southern and Rio Grande railroads are defendants. The members of the State Hallway commission conducted the exami nation of the witnesses for the plaintiffs, t. l. Powell, rate expert of the Nebraska commission, was oitjhe stand the greater part of the day. Attorneys for all of the railroads Interested were present. The question affects nearly the same number of Colorado towns as are af fected in this state. The railway commission claims that the rate of S3.W per ton charged from the Colorado points to the Nebraska towns is unreasonable and unjust and that the rate of $3 per ton would be a Just and reasonable rate. The towns affected by this rate are Sanborn. Halgler, Tarks, Penkelman. Max. Ktratton, Venango, Urandon. (J rant, Badrld, Elsie, Wallace, IMckens, Somerset. Wellfleet, Maywood, Curtis, Moorefteld. Ingham. Farnham, Trenton, Culbertson. Terry. MeCook. Red Willow. Indlanola, Hartley, Cambridge, Kdlson. Oxford, Beverly, Palisade. Ham let, Wauneta? Enders and Imperial. Charge la Too Maeh. The commission states that the rate of $.1.75 per ton is charged to the following towns in Nebraska: Marlon, Danbury. Lebanon. Wilsonvllle, Hendley, Beaver city, Stamford, Orleans, Carter, Alma, Republican, Naponee, Bloomlngton, Rlv crton. Franklin. Inavale. Red Cloud, lis ter, Guide Rdt-k. r.oswlck. Superior. Ever sn, Huntley, Ragan, Keene, Norman, Holstein. Itoseland, Ieroy, Pauline, Spring Tianch, Fairfield, Clay Center, Harvard, Inland, Halloran. Brlckston, Ayr. Cowlee, Angus. Nelson, Smyrna, Edgar, Deweese, Lawrence, nosemont, Bluehill. Bladen, Campbell, Upland. Htldreth, Wilcox, Sac ramento and Mlnden. The commission claims that the rate of $3.75 charged on (shipments to these towns is unjust and dlscrlmnatory as compared with the $3.50 rate to points between Holdrege and Has tings, Grand Island, Kearney and Aurora. Deny Ilate Injmst. The commission asks that the rate be reduced to $3.50 for transportation be tween the Colorado points and the points named. The defendants deny that the rates charged by them are unjust and un reasonable and the Colorado Southern de nies the allegation of the commission that iho Chicago. The evidence given today before the ex aminer by Mr. Powell was mainly the of fering of exhibits of waybills and time cards of the defendants In possession of the commission, which show the rates charged on various commodities from Colorado to the Nebraska points. Gives Road Figures. Mr. Powell gave evidence from the re ports of the railroads showing the ton nage carried by trains between points In Colorado and the tonnage carried between Colorado points and points In Nebraska. It nti thown that the tonnage capaolty of t ho same engines between some points In Colorado was from 50 tons to 1,050 tons as compared with the tonnage of 1,660 and 1.0") tons handled between some points in Nebraska. Some of the points between which the tonnage capacity of the trains was shown were Sterling to Palmer, Den ver to Oxford and Oxford and Holdrege. It was shown that the tonnage carried by class II! engine between Sterling; and j miner was j.juj ions; irom 1'enver 10 Oxford by an 11 4 engine with thirty cars was 1,190 tons, with fifty cars 1,055 tons; from Oxford to Holdrege with fifty cars 2.12G tons; from McCook to Oxford 500 tuns more could be handled. i I . ! - T1 iNuurasKa Millionaire Long Talks in Lincoln (From a Staff Correspondent.) Oct. 30 (Special ) The supreme court today was asked for a decision on the right of the state food commissioner to make a regulation pro hibiting payment for cream on the tlnv the cream Is tested. State Food Commissioner Jackson made the reguliitlon for the purpose of making cream testers more uoeurate. At least a half hour. Oct. .-Wlth the exception of a flfty-five-mlle automobile ride in a cold autumn wind, that swept over Chi cago's boulevards and parks, president Taft passed a quiet Sunduy here. He at tended church In the morning, luncheon at his hotel with John Hays Hammond. Postmaster Campbell of Chicago and a few acquaintances, spoke to several thou sand nrgroea near the dose of the auto mobile ride and tonight addressed the Chi cago Sunday Evening club on "Peace and Arbitration." The automobile ride through Chicago today was fast enough and long enough to place this city In the front rank of those which have.ntertalned Mr. Taft on his present trip Vlth flying automobile Jaunts. He was Tn the road without Interruption for about one hour and fifty minutes and In that time made a little more than fifty-five miles. His average speed' excluding the periods when he slowed down, was more than thirty miles an hour, with frequent bruststhnt brought the speedometers up to about a forty milo un hour mark. The boulevards and parkways over which the president and the entertainment committee speeded were crowded with automobiles nnd curious persons, but those in charge of the ride were evidently deteiinlifed that there should not bn a slow moment to It. Thcic wns not. Captain Larsen Rides Rapids of Niagara NIAGARA FALLS, N. Y.. Oct. 30. Cnptaln Klaus Larsen of Hctrolt today mado ri second Niagara river trip In a motorboat from the cataract to Lewis ton. He completed the six-mile trip through the turbulent water in twenty five minutes, coming through without a scratch. Iarsen says he Is through with Niagara adventures, but next year will make a trip ucross the Atlantic in his boat, tho Niagara. Larsen started from tho Canadian Maid of tho Mist dock at 1:50 o'clock and swept under the lower steel arch bridge five minutes later. Coming into Swift Drift, where the river breaks from the calm upper reaches to the rapids, he veered toward the Canadian side. The boat rode tho smaller waves without a tremor, but CHught by the fierce current about midway of the rapids, it was hulled up and almost dear of tho moun tains of water. Once the craft was side swiped and almost keeled over hy a comber. The rapids trip took hardly more than a minute. As the Niagara entered the whllr Its engine was working perfectly. Larsen kept toward the American side of the pool, but he was caught in a cross cur rent and was almost drawn into the vortex. Only the hardest kind of work with the tiller prevented trouUle. Once clear of the whirlpool, Larsen headed the boat up stream In order to put things in ship shape for the final test in the Devil's Hole rapids. He was badly buffeted In the lower rapids but managed to hold a course close to the Canadian sldo and nt 2:14 o'clock passed under the suspension bridge at Lewlston. He had made the five miles between the bridges In nine teen minutes. Luraen made his first 1 1 1 1 through September IS, IftlO. The Niagara, the host he used today.
