Armanda Hmlth, wife of C. R. W. Smith,
out of the state hospital.
Following Mrs. Smith's committment by
the Board of insanity Commissioners
Chambers started habeas corpus proceed
ings. Judge Kstells sustained Chambers'
contention In part and said he would sither
give Mrs., Smith her liberty or else sp
point a commission to mako Inquiry and
determine whether she Is a fit subject for
committment.
Mrs. Smith's attorney declared the In
ebriacy law unconstitutional. In that It pro
vides for the depriving of a person - k(
liberty without due process of law slid
trial by Jury.
On complaint of Mrs. Mary Larson of
Benson, aged 71, mother of Mrs. Smith, she
was arrested and taken before the insaaity
commission Saturday afternoon. On testi
mony of Mrs. Larson and Frank R. Smith, -Mrs.
. Smith's brother-in-law, the woman
was committed and sent to the county Jail
lo be held until Monday, when she was to
be taken to the hospital at Lincoln.
At the habeas corpus hearing before

Chambers said Mrs. Larson and Frank pt.
Smith are In league to get Mrs. Smith cvt
of the way on account of financial troubles
between the two women. Mrs Smith had
a small rooming house at 2231 Douglas
