three men under charge. Chief Brigga
Immediately executed tha order. In the
mayor' letter there waa an additional ad
monition to tha chief to Investigate ru
ora concerning tha reported open houaea
kept by many aalooakeepsr of tha city.
Chief Brlggi, after having cloeed the three
aaloona In question, was called to aooount
by aoma of tha police eommlseloner, who
questioned hi authority to close the place.
Tha chief In a few aantencea Indicated hla
Intention to obey the ordera of tha execu
tive head of tha board. Thla statement,
while it quieted for tha time any doubt
aa to tha stand taken by tha chief did not
Interfere with tha determination of Com
mission ere Ryan and Plvonka to reopen
the aaloona.
Tha three aaloona were aald to be open
again with an hour after tha chief and
tha mayor had ordered them cloeed.
Committee Meeflear Held.
Late In tha afternoon a committee meet
ing of the board waa held In the private
office of the mayor. The giat of the meet
Ing appeared to be an attempt on the part
of Ryaa and Plvonka te have tha mayor
iseue an order to tha chief to open the
saloons. Mayor Trainor bluntly refused
to agree to the auggeatloa of hla conferee
and Comrolaaloner Ryan, while expressing
a Jelre to have tha aaloona reopened un
til tha trial, admitted thai the mayor had
the power to keep them cloaed and aald
that If tha mayor Insisted upon hair star-
In-; cloaed he (Ryan) would aay "Amen-'
he order.
To thla Plvonka would by no raeana
agree and aaked that tha chief be aum-
moned to the meeting. Upon the arrival
of tha chief plvonka aaked why ha had
cloied the aaloona. Brigga replied that he
bad merely obeyed the ordera of the board
and that he would continue to do so.
Plvonka aeked him whether he considered
tha mayor aa the Board of Fire and
police. Brlgm aald he considered tha
mayor to ba tha chief executive of the
board and that ha could do nothing but
obey him whan he Issued ordera. Then
Plvonka aaked tha mayor If ha thought ha
had dona hla duty In ordering tha placea
cloeed without referring tha matter to the
full board. Tha mayor raid yea.

Having: satisfied himself aa to the minds
of tha mayor and chief. Plvonka suggested
himself and Ryan reaign If the mayor and
Chief Brigga ware going to conduct tha
affairs of tha department In such a man
ner. Ryan aald ha , would not reaign and
that ha would face anyone who aald ha waa
not straight In the conduct of police affaire.
He aald ha had heard, aa had all the board,
of tha wholesale dlaregard of the law by
saloon keeps re In tha city. Ha knew noth
ing of tha farts any mora than tha reports
He took It for granted that "where there
Is ao much smoke, there must be aome flra,"
but ha blamed tha reported tawleeaneas ponu
the lack of sufficient police to cover the
boats of the city. He further stated that
he had had aome reports about people who
were going "to put him behind the bare,"
but ha said he waa "clean" and bad no
fear of their machinations.
"Why did they select theea three men."
queried the commissioner? "Because," he
said, one waa a f-lend of Plvonka, and
Connie O'Brien la his friend. Cohn." he
said, "waa selected becauae he represents
tha Papal-Oelder Brewing company of
Warsaw. III. Ryan claimed that the fight
waa made by some local Interest who, he
beflevrd was against him because he had
aumej In the induction of Popal-Oeller
brewing Intereata Into tha city.

Just before the meeting adjourned. Mayor
Trainor left hla office tor a few momenta.
Plvonka Immediately turned hla attention
to tha chief and aaked If he absolutely re
fused to obey tha ordera of tha board.
Brigga reaponded that be had obeyed tha
ordera of tha board and cloaed tha thraa
aaloona. Ha told tha commissioners that
ba would not reopen them. Then Plvonka
told him that Its waa tha board's ordera
that tha aaloona be kept open until tha
trial today. Brigga at thl Juncture of the
roossding took a new tack and aald ha
va-xld open tha placea if tha board ao or
dered. In tha meantime ha went In search
of tha ttvayor. who waa expected to ee.ll
regular meeting and put tha two other
tnombera on record aa having counter
manded hla original order.
Ryan Leaai Toward Slayer.
Ryan again leaned towards tha rulings
of the mayor and Plvonka aald no more
when ba learned that tha chief required an
order In writing.
The case haa created much comment on
tha streets and aensatlonal developmenta
are looked for at any moment. It
aald by those who have tha prosecution in
band that Ooaunleatonera Ryaa and PI
vonka. In view of tha evidence, that baa
been gathered, may yet decide to reaign.

Local police are looking tor a man named
James Jensen, who walked Into tha South
Omaha National bank to cash a check
drawn on tha Farmer National bank of
Clarkson, Neb. The check Is drawn to the
name of TUlle Frexer and tha cashier asked
ensen how he came to have the check.
Jensen aald ha represented another man.
He aald he would go out and get the other
man and from latest accounts he la till
going. Tha police and bank officials think
that tha check waa forged.
Clcarette Castes Fire.
For a time tha police and flra depart
ments were Inclined to believe that a fire
started last night In the cattle pen of the
Union Stock yard waa the work of incendiaries.
Thla 1 tha second fir within two nights
in tha region of the L. street viaduct.
Tha first one. on Wednesday night, de
stroyed 300 feet of the viaduct proper and
last night the cattle pens were damaged
to tha extent of 110. Investigation made
by tha firemen seems to incline to tha be
lief that tha fir of last night waa due to
cigarette carelessly thrown Into a feed
bos In ona of the pena. The flra waa In
block 11 lot 1034, In tha vicinity of Boule
vard and L streets.

the frame cottage at Thirty-second and F
streets Wednesday night and caused a
damaae of A few hour after llgntning
struck in an alfalfa field at Thirty-third
and O streets causing a blaze that had to
be extinguished by the fire department-
Tha Kedmen Athletic association of this
city wired lummy uavigan of Cleveland,
O.. offering a bout with Billy Uvlck, the
local middle-weight. Uavigan la the man
who put up such a fast go with Jack Fus
gerald a year ago. The bout resulted in a
draw and aent liavigan'a stock kiting In
the pugilistic world. Ciavigan was formerly
a welter-weight, but has since climbed into
the middle-weight class, where he has won
a big reputation by defeating a number of
the best men ef that class The Ouvlgsn

With difficulty firemen carried her from
her room to the street below, where neigh

bringing ber to consciousness.
The fire had etartsd from an overheated
oven In the bakery owned by H. Good and
destroyed the basement of the bakery and
did considerable damage by smoke and
water to the Arnold pharmacy next door.
The apartment of Mrs. Smith were dam
aged by amoke and water. Tha bulldlns
which Is owned by Jacob Ringle,
damaged to tha extent of IkA.
