'T: OPPOSE OPENING OF
TWENTY-SECOND STREET
Board of Equalisation to Meet em
Wednesday to Consider Plan
of Assessment.
At the meeting of the Board of Eaual-
atlon which will be held today the
p. an of assessment for I he opening of
Twenty-second street will be presented.
Bo much opposition has b?en raised aislnat
th opening of the street that It Is said the
plan of assessment will be rejected.
Th objection to the plan rt assessment
s a technical one. W hen th t tract wua or
dered opened by the council two districts
wer created, on extending from Fan am
to Howard street and the other from Far
Bam to Dodge street. This was d no be
cause the law provjde that districts where
the damages are greater than $r0,0M cannot
be created. Aa th damagea awarded ex
ceeded $fi.0O0, two districts wer . formed.
But when th plan of assessment waa made
U damages were ataessed In one district.
Under th plan or assessment IGO.000 will
be .charged against the owners -of proptrty
between Twentieth and Twenty-fourth
Street an4 Dodge and Howard streets, and
th remainder In an outlvlnir t 4..
i whore Indirect beneflta are supposed to
have accrued.
Property owner in the Immediat vie n
Ity ct Twenty-second stieet, among t em
Joseph H. Millard, president of the Omaha
IXatlonsl bank, will onpos the plan of -essment,
claiming- that their property
damaged, rather than benefited. Their at
torneys will appear before the Board of
Equalisation and If they do not get a sat
isfactory deal they declare that they will
,tak th matter of opening the street Into
th district court. Some have hinted that
an Injunction restraining the council frara
Ordering th levy will be asked.
