vision 8 (Amendment 2 to B. A. I. Order
lt!7), to prevent the spread of scabies In
cattle, dated May 17, 1911, and effective on
and after June 1. 1911. The effect of this
order Is as follows: The counties of Tripp
and Gregory, In the State of South Da
kota; the counties of Keyapaha, Wheeler,
Garfield. Loup, Perkins, and that part of
lancoln county lying south of the Platte
River, In the State of Nebraska; and the
counties of Wallace, Greeley, Wichita,
Scott and Gray, In the State of Kansas,
are released from quarantine for scabies

MICHAEL FITZGERALD KILLED
WHEN CAR HITS AMBULANCE

Parmaum Street.
The county hospital ambulance, driven by
Michael Fltigerald, collided with a Farnam
street car at Thirty-eighth avenue at S:48
o'clock yesterday afternoon, throwing
Fltsgerald out and Injuring him so that
he died at 7:20 o'clock at St. Joseph's hos
pital. Fltsgerald was driving north on Thirty
eighth avenue. The car. In charge of
Mot or man Floyd Cockrell and F. L. Hodg
son, conductor, was running east. The
ambulance was upset, throwing Fltsger
ald to the pavement. He sustained a frac
ture of the skull, together with other in
juries. Police Surgeon T. T. Harris and
Dr. Shramek attended the man and ordered
him sent to St. Joseph's hsopltal.
Mr. Fltigerald leaves two ' daughters,
Agnes Fltigerald and Mrs. James Burke,
who lives at his home, 2419 A street. South
Omaha.

the Grahatake Plan of Taking
Homesteads.
T. V. Powderley. chief of the division of
the bureau of Immigration and naturalisa
tion, has sent a letter to D. Clem Deaver
of Omaha, colonisation agent of the Bur
lington, endorsing Mr. Deaver's plan for
the grubstake homestead law.
The grubstake law provides that two men
may take a homestead In partnership. One

decision In the American Tobacco case was
practically Ignored today In the American
second of London Stock exchange. First
prices ran (red from 4 above to 4 below
parity. The cut in steel prices in New
York caused weakneNs In I'nlted States
Steel and Amalgamated Copper, but rail
road shares under the lead of Canadian
Paclflo rallied. The close was very firm
and gained t points and Union Pacific ad
vanced 1 on buying orders from New
Tork. lAter trading slackened and Can
adian Pacific lost a point, but the rest of
the list hardened and closed steady.

lor cheaper cost appeared in stumpy east
ern conditions and the only good feature
aoout tne market was an immediate but
limited demand for stock to keep killing
gangs at work during the morning, in
order to get action upon two or three
pressing orders, buyers purchased a few
hundred head of lambs early at moderate
discounts, but tne rank and file Insisted
upon large reductions In prices.
I oral receipts were moderate and ran
largely to wooled Mexican lambs, an In
dividual ten-car shipment showing up from
the Gould feed lota. Shorn lambs, with a
sprinkling of old sheep, made up about half
01 tne supply.
BluKglsh tone to trading continued
throughout the entire sexsion and scale
ward movement of offerings was permitted
only after the list of Drlces had been se
verely trimmed. Sheep suffered less than
tamos because or a famine run 01 the for
mer class of stock, but weakness was

Rest figure for wooled Mexican lambs
proved to be 17.00 and shorn western

PAWNEE f'ITT, Neb., May SO. (Spe
cial Telegram.) D. A. McVitty, his wife
and two children, were murdered Monday
morning with C hammer by James Fielder,
a farm hand, at the McVitty home, seven
mllrs south of here.
The murderer fled and when discovered
In a school house by Sheriff Claude Fuller,
shot the officer three times, fatally.
Fielder then committed suicide. Sheriff
Fuller died tonight.
Two other children of the family of eight
children are In a serious condition and not
expected to live as a result of the man's
fiendish attack.
The motive for the deed was revengff
upon Mr. and Mrs. McVitty, who had re
fused consent to his marriage with their
daughter Jessie, aged 18.
The assailant was a thresher. 84 years
of age, who had worked for McVitty and
while in his home had paid court to the
daughter. The parents were firm In their
refusal to permit his attentions, so about
two months ago Fielder secured employ
ment wtth Frank Iloren, a neighbor. The
murderer had been heard to say that he
would fix the McVlttys If they Interfered
with his suit.
Father Refnsee Him.
Last Sunday evening before duk Fielder
called at the McVitty home to see Jessie
and when he left a short time after, asked
to return, but was denied the privilege.
He then went to the home of Ernest jonn
son. who lives In that neighborhood, and
remained for a short time. After leaving
the Johnson home, It Is not known where
he went, but some time between 1 and 4
o'clock this morning he returned t9 the
McVitty home, and not finding any of the
doors locked, he entered, presumably with
the Intention of wreaking his vengeance on
the family and securing the girl.
Picking up a hammer he entered the
northeast bedroom on the ground floor
where Mr. McVitty, his wife, daughter
Nettie and a little l-year-old baby were
sleeping, and struck Mr. McVitty over the
head, crushing his skull and killing him
Instantly,
Fielder then attacked Mrs. McVitty, and
from appearances, attempted to assault
her, stifling her screams by choking her.
Being unable to accomplish this, he killed
her by crushing her skull with the hammer.
The murderer then attempted to assault
little 6-year-old Nettle, and In trying to
subdue her, broke her neck.
Leaving this room he went upstairs and
entering the southeast bedroom where the
three boys, Bobby, 7 years old, Frank, 14
and John, 16, were sleeping, attacked them.
John was struck upon the head but not
injured badly. Frank received a crushed
skull, and was operated upon several hours
afterwards In the hope of saving his life.
Bobby received a fearful wound In the
back of the head and later died. "
Takes Girl Away.
Jessie, who slept In a northeast bedroom
upstairs with the other 1-year-old baby and
sister Fannie., aged 10, was awakened by
the noise and was Just getting up when
Fielder entered her room and by choking
and threatening her, forced her to accom
pany him to his buggy.
The murderer then drove two miles
south, and getting out of the buggy,
Fielder toTVrt"r to return home, sayjng
that the folks Vera all right and that
they would find him In a brush pile. Jes
sie, upon returning home discovered the
terrible crime and at once telephoned to
neighbors.
Sheriff Fuller . was called and at once
left town for the McVitty home. Taking
a team and wagon and accompanied by
two men, they started In pursuit. They
tracked Fielder to the Leply school
house In Kansas, one mile south of the
Nebraska line. Thinking that Fielder
might be in the woodshed, the sheriff ap
proached .unarmed. He called to Fielder
to surrender and the man replied that
he would come out In a minute, then
throwing open the shed door, Fielder fired
three shots at the sheriff, two bullets
entering the officer's abdomen and the

had been shot down, Immediately left ,
for help, in the course of an hour and !
a half a posse had been formed find sur- j

that Fielder had already ended his own

woodshed and found Fieliler dead. They
picked the sheriff up In his wounded con- 1

of this country for ten years and for tl e I
last three years have lived on a farm

farmer, running a threshing machine for '
several seasons, and was well thought of

Two Likely to Hie.
Out of this family, consisting of the
parents and eight children, the father,
mother and two children are now dead.
One .boy Is seriously injured and not ex
pected to live, and the remaining five es
caped with slight bruises. Among the less
serloufly Injured are the 2-year-old tains.
James Fielder, the murderer and sui
cide, had been In this vicinity for the
past three or four years, having come
here from Tennessee, where It Is said he
owned some property. He owned a half 1
Interest In a threshing machine outfit
and had worked for McVitty much of
the time. Fielder Is said to have rela
tives In Table Rock, this county.
