for practicing In a court of record without
being a duly admitted attorney was filed
in county court yesterday afternoon by
George D. Ablon, an elevator operator at

Burdge, who is a collector, has been
pleading cases In the Justice courts. A
number of weeks ago Burdge took ths case
of a client of his against Ablon for some
house rent to the county court, acting In
the capacity ot an attorney. Ablon's at
torney moved mat it be struck out, as
Burdge could not practice In a court of

of the committee of the whole of the city
council, when Councilman Herka. cham
pioning a rock pile for Omaha, wus told
to go ahead and make arraiiRemcnts for
a geological garden. The arrangements,
in the main, consist of ftirnlshiim the
necessary rock. . on which the Weary
Willies and others may sxerclee.
Beika was told to confer with the city
engineer's office and formulate plans for
the rock pile and its location. He will
report the fruits uf his eonference to tlie
city council tonight, and if a resolution is
needed It will be ' Introduced by Berks.
Its parage Is . assured. Herka says, for
the members of the council have declared
unanimously In favor of the Innovation.
However, acme members contend that a
resolution Is not needed for ths project.
The legal depaitment will be consulted on

were awarded the contract for laying
sidewalks In Omaha during the year. Tho
contract price calls for 10 ocnts a square
foot where brick Is uaed. and 11-cents a

Sesto & Vacant! were given the con
tract over Noble Bros., who also bid 11
cents for asphalt, but the latter firm failed
to bid on grading and on -brick,, so the
ecntraot was let to Sesto & Vacant!.
Attorney Magner, representing Noble
Bros., agreed that his firm would do the
grading aa cheaply as the successful bid
ders, but the council took no oognlkance
of the offer. In view of the fact that It
was not mads In tho sealed bids.
Sesto satisfied the council that lie could
furnish a surety bond. Some question was
raised that th firm could not furnish
bond tn view of the low price hid. But
Sesto dissipated all doubt.
Despite the protest of attorneys repre
senting R. Flnkelsteln, ths ordinance pro
