today In all the principal ataple on change.
Covering of a big line of corn by a prom
inent short gave the rise a touch of the
apectlcular. Apparently thla Incentive came
from alarming rabies regarding the Argen
tine drouth. The close was lifflV to lc
higher than last night. I .at em price for
wheat showed a net gain of 'ijj1V to
IV:, oats were up VBV. "d provision
more expensive by 7V to a trifle beyond
an even half dollar.
Hour after hour 260.000 bu. lots of corn
were being bought In for a widely known
dealer, who recently wa credited with
having been a ahort-aeller on a scale of
unusual magnitude. Simultaneously with
the Argentina scare, country sales had al
most vanished, and export buslneaa picked
up rapidly Furthermore, the number of
cara arriving here exhibited a decided
falling off In consequence of the wet
weather and the small loadings last week.
Dispatches from Buenos Ayres were bullish
In the extreme. One said that unless the
drouth soon changed. . the surplus for
Kuropean ahlpment would be small, if there
was any whatever. May ranged from
4&V849V to &0V, with the finish firm, IV
up at the topmost level reached. Cash corn
waa strong; No. 2 yellow, 474i47'ic at the
close.
Wheat regained without trouble the
ground lost yesterday. Primary receipts
were light enough to give the buying side
a good deal of encouragement and there
was a liberal decrease In the world's avail
able supply, outside markets were slow
to respond to the bulge here. Mav fluct
uated between .1.001, an(J $.oi'i. with latest
figures IWcdV dearer at the high level.
Oata followed corn. May had as low
and high point. 2-SV and .lt'c, he latter
pervading In the end.
Provisions were Mrong all dav. Last
sale, pork, 30c to 62V higher; lard up

falling this morning in eastern South Da
kota. Minnesota, eastern Nebraska, Iowa
and east over the upper lakes and lower
Ohio valley. It Is raining at St. I.ouls
and south to Memphis and at points In
Texas, and generally cloudy weather pre
vails' elsewhere east of the Mississippi
river. The weather has cleared generally
throughout the west and northwest, ex
cent on the Pacific coast, where It con
tinues cloudy with some rain. Tempera
tures are slightly higher in the central
valleys and lake region and on th Pacific
slope. They are lower on the Atlantic
coast and In the Rocky mountains. The
weather will continue unsettled In this
vicinity tonight, followed by generally

count, but the Brazilian markets appeared
to be somewhat unsettled. There was some
talk of lower firm offers and there seemed
to be a feeling that owing to the failure
of Brazilian receipts to fall off aa rapidly
as expected and the prospect for valoriza
tion offerings In April primary holders In
some instances were becoming uneasy. At
any rate prices here reacted a few points
fl-om the top during the middle of the day
under realizing or local bear pressure, but
later firmed up again on covering and bull
ish private reports from Europe, with the
close steady at a net gain of 3fil6 points.

The general market this morning showed
very little change on beef steers, prices as

those who had the less desirable kinds

started proceedings lo lest the constitu
tionality of the law. She protested against
the Stone-Tracy company niHklng the re
turn and paying the tax. because Hhe
claimed that the law was unconstitutional.
The circuit court of Ihe United Slates for
the district of Vermont could not tako
that view of the law, and Hliu-e directed
Usat her petition be dismissed. She ap
pealed to the supreme court.
Other Similar Mull.
The course pursued in the Vermont rasa
was followed in seventeen other suits
brought In almost as many circuit courts.
In all the law waa upheld, but without
extended consideration. The theory wan
that the supreme court would conduct an
Investigation into the constitutionality of
the law and that the conclusions of the
lower court would aid but little while it
would delay the final determination.
The major part of these case! were
argued before the supreme court last
March, but all were restored to the docket
for reargument before a full bench.
The legal contest Is centered largely over
the consideration of a few words In the
extended provisions, relating to the tax.
The words are these:
"That every corporation, Joint stock com
pany or association, organized for profit
and having a capital stock represented by
ahares, and every Insurance company
shall be subject to pay annually a
peclal excise tax with ' respect to the
carrying on or doing business by such cor
poration, Joint stock company or associ
ation, or Insurance company, equivalent
to 1 per centum upon the entire net In
come over and above $6,000 received by It
from all sources during such year, ex
clusive of amounts received by It as
dividend upon stock of other corporations,
Joint stock companies or associations, or
Insurance companies, subject to the tax
hereby imposed."

of view. Maxwell Evarts of New York
laid stress on the point that the law was
unconstitutional because It Invaded the
sovereignty of the slate by laying burdens
upon the corporate franchise granted by a
state to a corporation. Former Senator
Foraker of Ohio contended that despite
the name given to the tax that it was a
"ciirporatlon Income lax," audi as were
proiounced unconstitutional by the de
cisons of the court fifteen years ago. Be
sides these two conflicting arguments many
others have been adtaticvd by the long list
of counsel engaged in Ihe various 1 ascs.
