containing 14 per cent or more of water
is to be taxed as "adulterated." The ques
tion of the water content of the confiscated

definition of a manufacturer of adulterated
butter. The West Point company contends
that admitting butter containing more than
the legal content of water may have bet-n
turned out of the plant by accident, it was
not and Is not in the business of making
adulterated butter by purpose and design.
Therefore, the plaintiffs say. they should
not be taxed for a business in which they
are nut engaged.

Case, the butter maker, is testifying for
the purpose of showing the care which the
company has betn taking to measure the
water content of Us products. The com
pany Is seeking to thereby make good the
declaration that the manufacture of butter
designated as adulterated because of the
excess moisture was purely accidental and
lnc.dental to the conduct of its industry.
The case on trial assumes special Im
portance to the butter Industry In that the
ruling made will affect a large number of
differences which aow exist over the coun
try between the makes of butter and the
Internal revenue collectors. By the finding
of Judge T. O. M unger the slgn.flcance of
the question of intent on the part of the
butter manufacturer will be established.

ocean going mails was announced Satur
day by the Western Union Telegraph com
pany. The new service Is practically an
amplification of the night letter service.
Letters to go abroad may be telegraphed
to the coast at the usual night letter rate
plus 6 cents for foreign postage and will
there be mailed by the telegraph company
in a specialty addressed envelope. Thus
a letter from Omaha may be wired to New
York a few hours from the sailing Une of
a mail steamer arriving at the European
destination in the time required for th
ordinary transit of the mails to reach the
seabrd.

thing about the build ng will be finished

Two days' work remains to be done on
the roof of the deot. and another week
will see the brick work completed.
The retaining wall, which must be fin
ished before the tracks for the terminal
system can be laid. Is progressing and Is
expected can be done In time for the tracks
to be ready when the building Is complete.

on the three acts of buildings being erected
by the I'nlon 1'acific. Ten stories of the
steel work of ' the big headquarters struc
