LINCOLN, MuV. 29 -(SpoaJ.) Arthur
Mullen, attrney general, has grime to
Washington, where he will rfpiwar In de
fense of the guaranty bunk law, which
u the climax of the work of the late
emocratlo legislature, which was largely
eon trolled by Mr. Mullen, then an oil ln-
pector. Mrs Mullen did not apiwar as
attorney of record In this case until after
he had become attorney general a few
say ago, but the argument for the state
wm made by Judge I. 1 Albert of Co
lumbus, C. O. Whedon of Lincoln and At
torney General W, T. Thompson. Mr.
Thompson Is now In "W ashington, having a
position In the Treasury di partment, and
It is understood he could present the rase
for the state; or Judge Albert could trpm
aent the state; but so Important Is the ta.se
from the standpoint of the democratic leg
islature that Mr. Mullen felt that he ought
to be present to look afer the constitu
tionality of the law. Besides, these other
attorneys mentioned lost the case In the
lower court.
The atate will pay for the Junket.
Th Doaahae Case.
It may be Borne time before Chief of
I'ollce Donahue of Omaha Is haled befoie
the supreme court on the charge of per
mitting the liquor laws of the state to be
violated. Arthur Mullen, the attorney gen
eral who will do the prosecuting for the
tate, which he thinks Is the aggrieved
party, will not return to LJnooln from
Washington before December 7. The court
boa not yet named Its referee, and so by
the time the referee and stenographer ire
(elected, Mr. Mullen may be practicing law
back In O'Neill or accepting a commission
to be special prosecutor of the attorney
general to look after the corporation cases
he la to start December 6. Mr. Mullen
made this statement Jurt before leaving
(or the east today:
"The court has not appointed a referee
to take the evidence. Nothing can be done
until this appointment Is made. I expect
to be back from Washington about Decern,
ber 1 or 8, and then the Donahue case and
other litigation connected with and grow
ing out of It, will receive attention."
Governor Shallenberger has received a
letter from the military department of the
Vloksbury National Park Cemetery associ
ation urging him to see to It that the legis
lature makes an appropriation for the con
struction of a portrait statue In memory
of the late Oeneral John M. Thayer of
Nebraska.
An Inanrance Case.
8 tate Auditor Barton listened to a com
plaint of Dr. Myers of Howella this after
noon, who alleged he bought something he
thought was something else from the Se
curity Mutual LUfe Insurance company. Dr.
Myera said ha thought he was buying a
twenty-year paid up life Insurance policy
and when It wa delivered to him it turned
out to be a twenty-year ordinary life. He
had given his note for 198 for the pre-
tnlum and ha did not "fcfj it to "have to paj
that note. Dr. Atkinson, the agent who
aold the Insurance, presented the applica
tion aa his defense that Myers had got
whftt ha bargained for. The application
was for a twenty-year ordinary life policy.
The auditor has the case under advise
ment. ,
Snageatlona to Governor.
Those who have suggestions to make to
Governor Shallenberger for the guidance of
legislation would do well to file them now
dur.ng his absence, for when the governor
returns from his trip to Chicago and Ken
tucky he will at once get his message In
Bhape for the Inspection of the lawmakers.
It Is a certainty almost that the governor
will recommend the open primary be closed
at once, and he will wish perhaps to urse
the repeal of the law, though he may not
Bay so.
He will urge probably civil service in
Bome of the atate Institutions and thus

recommend that automobiles be taxed ac
cording to their horse power in lieu of all

to the amount of money paid by owners
of automobiles In each county. He will
urge that each county then may use the
money thus collected when an equal sum
Is raised by taxation In that county. The
governor has discovered that laws similar
to The one he will recommend have been
enacted In several eastern states and the

George Watts. He leaves a widow and a

Hastings, who had eloped and when found

among the early pioneers. They are very

opce for California, where they will spend
the winter, returning home In the spring.

NEW YORK, Nov. 29 The kidnaping
case originating five years ago in whlcn
the late Lieutenant Petroslno, who was
murdered In Italy, played the part of In
vestigator, la believed to have led Indi
rectly to a bomb explosion In the early
hours today, which ahook up one of the
most thickly populated blocks In New York,
did extensive damage and created a panic
in the neighborhood.
The bomb exploded In the doorway of the
Bella Trlnaorla saloon. In the heart of the
Slcllllan section of Elisabeth street. It
completely wrecked the saloon, the front
of which waa blown inward, badly dam
aged adjacent stores, hurled sleepers in
the tenement above from their beds and
cracked windows for blocks away. The
police reserves had their hands full quiet
ing the panlc-tsiicken foreigners, who
flocked to the streets by hundreds.
Francesco Le Barbera la the owner of the
saloon. He had left the place about half
an hour before the explosion. Today he
gave the police his theory of the animus
behind the outrage. About five years ago,
he said, his son, Peltro, six years old was
kidnaped and he haa never heard from
him. The police were notified and Lieu
tenant Petroslno worked on the case. La
Barbera received many letters threatening
his life If a large sum of money waa not
paid for the return of the boy, but paid no
attention to them and it is believed by him
that the kidnapers are now starting In their
revenge.
