ment to the constitution of the United,

delve Into constitutional law, and thq case
of the Missouri Pacific against the city of
Omaha will offer opportunity along- that
line.
The property Involved was originally
owned by the Omaha Belt Rallday com
pany, but according to the petition on
file In the United States circuit court the
Missouri Pacific Kailroad company pur
chased it from the Belt line January 19,
this year.
There la legal war between the Missouri
Pacific Kailroad company and the city of
Omaha war to determine whether the city
hall condemn the property at Fifteenth
and Nlcbolan Mreetn. upon which la lo
cated the freight depot, sidetracks and
other appurtenances of the plaintiff cor
poration. K. A. Frogan. local attorney for the Mis
souri Pacific, has secured from Judge
Munger of the United States circuit court
m temporary order restraining the city and
its agents from In any way interfering
with the property In question. This order
Is returnable next Friday, and at that time
the case will be argued on Its merits.
This action comes consequent to an ordi
nance passotl, by the city council July 6,
this year. In which It was declared neces
sary to appropriate the south thirty-eight
feet of lots & at.! . these lots being a part
of the Missouri Pacific depot grounds, also
the alley adjacent for the purpose of wid
ening Nicholas street from Sixteenth to
Thirteenth streets. The necessity of a
viaduct along this route wax alt-o declared
necessary, and a committee of freeholders
composed of Otto htuiiun. 11. A. Hobba
and O, A.' Sou was appointed to render
appiaissj of damagts Incident to the con
demnation of property required by the wid
ening of the street -and the construction
of the viaduct and lta approaches. "
