Tho alleged Assault occured near Miss Boyce'a home on tho night of April 16th last as she was walking from the street oar. It is charged that Powell, who was wearing tho uniform ot a private of the Ninth U, S, cavalry, although not a member of that or ganisation, made certain threats, and Miss Boyce screamed and attempted to get away, when Powell fired a shot, then beat his victim over tho head with tha butt-end of tbe gun, and also choked her. A few days following tha aasualt 1,000 members ot tha Ninth cavalry were lried up In single file for tier Inspection, but she failed to Identify her aasallant. Later Powell was arrested and brought before Miss Boyce, clad In the military uniform, and , she Identified him as her assailant immediately.
