The understanding here was that Bush

General Gnnville M. Ivle, who testified
on behalf of Major Richmond ycsteiday,
said he had been personally acquainted
with the accused officer for a number of
ears and that he considered him a thor
oughly honorable man.
Geneial Iodie paid he d.d not consider
Major Richmond at fault for the conditions J beehive in
that had existed. "It is the duty of an
officer to obey the orders of his superiors
and in this case It was the duty of Major
Richmond to obey the Instructions nf the
mayor and city council. During my life
I have many times carried out orders which
I regarded as Illegal. I obeyed them with
out stopping to uuestion their legality."

raid he did not consider that Major Rich
mond had violated his oath of office In
attempting to regulate and restrain certain
forms of civic vice, the suppression of
which had almost been found an lmpoasl
bility In all large ciltea throughout the
world.
V. H. Killpack. president of the Law
Enforcernent league and county attorney
for six years, during one year of whose
term Major Richmond was chief of police,
admitted that he had tailed to close the
gambling houses or the houses of 111 fame
during his Incumbency of the office of
county attorney. He laid the blame for
his Inactivity at the d'r of the police,
who. he claimed, refused to give him any
assistance.
Former Mayor De'.l G. Morran and C. A.
Tlbita. chief of police under Morgan's
regime, testified as to conditions being
similar during their terms of office as
durlau the administration of Chief Rich
mond and that the same etera of assess
ing the gambling houses and the women of
the town waa in vogue during their terms.
City Clerk Casady was examined as to
the records to show that all moneya re
ceived by the chief of police passed through '
his hands, and from him to the city treas
urer. Tony Jensen. Chrla Kretchmer, E. J.
Brant and Jim Hansen were placed on the
stand in rebuttal of the testimony of Rob
ert B. Wallace relative to the Manhattan
saloon seiling liquor on the day of election
on which Wallace waa defeated for mayor.
They testified that Major Richmond closed
the place, and that later the proprietor of
the place was arrested and fined 11.000 for
violating the law- by having, his saloon
open on election day.
A number of leading business and profes
sional men, including H. W. Binder. G. H.
Mayne. J. C. Fleming and M. Marcus, tes
tified to conditions in the city being. In
their opinion, greatly improved since Major
Richmond had been at the head of the po
lice department.
Sheriff McCaffery and Deputy United
states Marshal Gronewe j, who were deputy
sheriffs under Sheriff Canning, testified
that they did not learn of the presence of
the Mabray gang In Council Bluffs until
after the whole matter had been exploited
in the newspaper?:.

Frees, five mllee east of iraln. was badly
hurt yesterday afternoon. He was discing
in a field and drove his team too close to
the fence. The singletrees caught in the
fence and soared the team, which turned
very quickly and threw him from his seat
to the ground In front of the dic. which
pajed over him as the horses ran. He lies
in a very dangerous condition and phys
icians say that he will no doubt lose on
of his leg.

Mrs. J. R. Rice had a remarkable escape
from death when he climbed on top of a

Mrs. Rice heard the child scream she
rushed to the door and aaw him falling
off the top of the hive while bees swarmed
thick around him. Running to him she
carried him Into the bouse and was badly
alung herself. The infant, despite the fact
thai he had forty-eight slings on his legs
alone, will recover.

MARSH ALLTOWN, la.. April . (Ppe
dal.) Hobert I. Beale. the Postal Tele
graph company'a operator, who was ar
rested here yesterday, for having a ring,
which the police believed was stolen from
the Rock Island wreck, near Green Moun
tain on March 71, was sent to Jail for fif
teen days when arraigned at Toledo. Beale
pleaded guilty to the charge of having
atolen six pillow slips from the Pullman
sleeper Colotila. which was one of the cars
wrecked. While held in jail on this charge
the police will try to find out who owns
the ring which was set with seven dia
monds and six opals so that a second
charge can Le lodged against Beale.

CARROLL, la.. April (Special.) W. D.
Salmons, much wanted at Si. Joseph, Mo.,
Is in jail here awaiting extradition. He
had been heie ten days and was living w ith
a woman formerly of Halbur. Salmons has
a wife and family at St. Joseph and has
forfeited a bond there.

Creek.
Another voting precinct was added yes
terday to the already long Itst in this
county. Acting on the petition of the
voters in Silver Creek and Keg Creek town
ship, the Board of Supervisors established
what will be known as Treynor precln.-t.
The new precinct is formed of the east half
of Keg Creek township and the west half
of Siller Creek township. The three pre
cincts of Treynor. Keg Creek and Silver
Creek will each be four by six miles in
extent.
