The demand for beer steers was very
good and both shippers and packers were
out In the yards early in the morninfg
picking up the desirable kinds about as

paid looked tuny 10c hitther than yester

market on Monday. Oood beef steers sold
up to $7.10. 1
Cows and heifers also participated In the
general Improvement, ithey, too, selling loo

HOGS Even at the risk of tame repeti
tion, It becomes necessary once more to
elate that the local hog market has again
broken all previous price records. Selected
loads Sold this morning as high as $9 35 and
the bulk, wildly higher; in fact, nobody
st-emed to know Juni how much higher the
general 1 market wss thsn yesterday's gen
eral ttade. The lowest estimate, a dime
advat.ee, gained but scant circulation at
til opening, most of the talent calling
averag trade a flat' 16c higher than yes
terday. Thera may have been a few scat
tered load that sold only a dime better
during first round, but the volume of
business on thta bails was weaker and the

I. e.ier In the morning after moat of the
t)o had been rerelrd. the. demand became
even more urgent than early, and prices
Were marked up an additional nickel In
both' divisions, bringing the average mst
,kat up ta a 15 3i0o higher level 11 im
pared with yesterday, with . a top of $9.36,
the highest on record.
Aside from the sharply higher trend of
4-aJuea. tha demand could almost be de
crtbrd as clsniuioua. Moat ot tha local

thai very thing on sei moved toward Utt

SHEEP Tha situation In the shfep barn
this morning was in most respects very
similar to mat' of recent days. Nothing
especially new developed as far as prices
were concerned, but plehty of activity fea
tured tha demand and everything sold Just
about as fast as received. Estimated re
ceipts were barely normal with the big
portion of early arrivals consisting of ewes
and yearlings. Siock of the latter descrip
tion told up as high aa IvOfi, which Is the
hli-heat nrl,-a ever naid at this Dnlllt for
full loads of fed western yearlings. Oen-'
erally speaking, most sales this morning
ware about in the samo notches as yes
terday, with the market Aa a whole, quo
tably steady.
The aupply during the three flays this
week shows little change from nrevlous
runs, but the demand, especially for good
kinds of sheep, has been decidedly urgent.
Flesh and finish naturally command
greater premiums than medium quality,
but everything has been selling very well.
Current Quotation on flnliihrd ewes, weth
ers and yearlings are easily a big dime
higher than last wek's close, and lambs
also show more or less Improvement.

little attention. The market, however, was
very much unsettled, and while active

JURYMEN RESENT A REBUKE
Court Called
Doira , for Overwork
no; n rrlvllcare
' Bench.
Prlvlleare of the -
'f -
Respect and honor are due to the Brook
lyn Jurymen who' have ' protested against
the action of County Judge Fawcett of
Kings oounty. New York, in rebuking them
because he was displeased with a verdict
of acquittal and In discharging them from
further Jury service at the present term of
court by reason pC his Judicial displeasure.
These gentlemen point out tl at they have
not Sought of their own .volition to partici
pate In the administration of Justice, but
have been compelled to do so In therdl- ,
charge of a highly Important civic duty;
thatthe law Imposes upon them and hot
upon the Judge the responsibility of de
termining whether or not a defendant Is
guilty beyond a reasonable doubt; that
Judge Fawcett himself Instructed them to
acquit In the case which called forth his
criticism If they entertained any reason- .
able doubt as to the guilt of the accused.
They . Insist that the verdict which they -rendered
was the necesjafy and legitimate ,
expression of their unanimity in entertain
ing such reasonable doubt. Hence tliey
can perceive no propriety In tho condem
nation visited upon them from the bench.
'Neither can we. The Jury "scoring-" ,'
habit Is a gross abuse of power for which' "
there Is no Justification In law, and we
arc glad to believe that It Is a compaia
tlvely modern Innovation for which "The
precedents are not numerous. It cannot
too soon be completely abandontd. We do,
not quiHtlon tho right of the public to ex
Dress dissatisfaction with the verdicts of
Jtarles. It has the same right 'to express
dlssatifaction with the declslo'n8''of Judges.
There Is no branch of tho government,
that can claim immunity from public crltl- 1
clsm under a free government. A criminal
court, however, consists of two parts, each
discharging - a function wholly distinct
from that of the other the Judge, who,
deals with the law of the case; tho Jury,
that passes upon tho questions of, fact. t
Neither Can properly Interfere , with the
duties of the other, and in the absence of '
misconduct on the part of the Jury the .
Judge has no more right to condemn it
from the bench for a verdict of aoqulttal
than the Jury would have to'crltlclze his
law.... . ,
It is difficult even now to obtain good
men willing to serve as-Jurors In our gnat
cities. It will soon be Impossible U, reput
able citizens know thoy are liable to a
Judicial "scoring'.' In- case they deeln It
their duty under the oath which they have
taken to acquit a defendant whom the
judge thinks they ought to have found
guilty.
We commend these Brooklyn ' Jurymen
for their courage in. protesting against a
growing abuse of Judicial power. New
York Sun.
