' Construction News, In Its Issue for Feb ruary It. will present a tabulation show ing a decrease In building during January of this year as compared with the same month of 160. The figure a for Omaha show a gain of 4 per oent, which the author of the tabulation says would undoubtedly have been much greater but for the long continued cold weather and the severe snow storms. , Most of the heavy gains In building are In cities where good weather prevailed. Among those cities showing a heavy fall--! tng off In building operations are New York and Brooklyn, Chicago, Pittsburg, Buffalo, Cleveland. Milwaukee, Toledo. Those showing gains, besides Omaha, are Louisville, SL Louis, Kansas City, Port land, Indianapolis, Minneapolis and Cincinnati. QUIETUS ON BILLBOARD LAW ORDERED BY JUDGE ESTELLE Restraining Order Granted Three Years Ago Becomes Iujanctlon by Rallngr of District Court. . A temporary injunction Issued by district court now stands against the billboard ordinance passed three years ago by the city council and which was Immediately put to sleep by a restraining order. Judge Estelle has handed down a de cision which nullifies the ordinance as it stands, because ot several provisions held to : be unreasonable. Other restrictions against billboards are declared perfectly valid and Assistant City Attorney Dunn, who has had charge of the old ordinance case, will draw up a new one In accordance .with the decree of. the court. . Judge Estelle asserts In his opinion that the city haa a right to regulate billboards as to height and general construction and holds that the limit of eleven feet aa pro vided in the enjoined ordinance Is not un reasonable. It would be less arbitrary, nevertheless, says the court. If qualifications as to height were made to conform to tho ordinary unit system of billboard construc tion. Dut the city, declared Judge Estelle, has no right to say that billboards must be twelve feet or ten feet or any other dis tance from the lot line and boardings may be erected, if desired, exactly upon the sidewalk line. Nor haa the city a right to prescribe a gap of twelve feet from the end of the boarding to adjacent building. Some aort of opening through which fire men could get In event of necessity is rea sonable, but not all of twelve feet. The city may exact a permit and a bond, but the system of requiring payment, be sides the ltc3r.no, for each bl lboard amounts to double taxation, In the opinion of tho court. The fight between former Mayor Tom Hoctor of South Omaha and that city over the building; of Hoctor boulevard has be come so sharp that It finds Itself In fed eral court. The General Construction com pany engaged to build the road has ob tained a temporary restraining order to prevent the city council of South Omaha from repealing the ordinance authorizing the construction of this street. The order la returnable before Judgs W. H. Munger February ,16. The city council of South Omaha passed an ordinance some time ago providing for the construction of this boulevard and later threatened to repeal the ordlnanoe after having entered into a contract with this company. . .
