Attorneys asked for an opinion consult the code and say the matter is uncertain. It seems to be clear that each of the three offk-lals Is sure the duty does not devolve upon him. Deputy sheriffs have taken into custody Charles Noyes of Waterloo. Noyes must appear before the Board of Insanity Com missioners on a charge of inebriety. Mrs. Noyes is the plaintiff. Mr. Noyes trUd to have informations lodged against his wife and Miles Nell, also of Waterloo, but County Attorney English declined to proceed unless Noyes can furnish more evidence than his own story. "You tell an interesting narrative about the emptying of the revolver," said Eng lish to Noyes, "but you must prove it, if a case is to be started." Mrs. Noyes denies the tale which her husband tells about herself and Neil meet ing and Noyes shooting at them with a revolver which would ndt discharge, be cause there were no cartridges in it. .
