produot was, however, not grown In Cali
fornia, but In Nebraska.

name which has been attached to Mis
Rachel Burbank of.Kearney, Neb., a rela'
tive of the great Luther Burbank. the wiz
ard of fruits and floWers of Santa Rosa,
California.
This Miss Burbank is one of the most
faithful of the students of the domestic
science department. For two terms she
hsa been making an exhaustive study of
the construction of salads under the di
rection of Miss Jessica Bteack. the head
of the domestic science work at the corn
exposition.

beer, the first in his experience, started
Ruesoll Howard, a 17-year-old chauffeur,
upon a wild "Joy. ride" last night that
endaal In the death of a pedestrian and ths
arrest of Howard and threa companions
early today.

said Howard In his cell. Two women and a

Howard said thst when he drank the
two glasses of ber last night he wanted
to "have a big time." 8a he took his em
ployer's machine from a- garage at 406
North Twelfth street.
Then reckless of speed or safety, he drove
the big touring ear ever the boulevards of
the wast-end and back to the business dis
trict. At Ninth and Market streets, Dennis
Short, 960 Clark avenue, failed to dodge
the Tying machine. It struck him squarely
and killed him Instantly.

.affair. It was not an honest suit. It
does not represent a true condition of facts,
; but a fictitious condition built up for the
purpose or this suit built up for the pur
pose of divesting these minors of their
rights built up to deceive the court.
It was not a trial In fact. It was a
farce, a fraui, a fraud upon this court,
a fraud upon the minor children.
"Before the contract between Charles D.
Sutpnen and George A. Joslyn wss made,
this scheme was hatched and made un aa
to the method of trsnsftrring the properly

Mr. Gilbert rehearsed briefly ths facts
which have led up to the present suit.
These Included the will of Emily eiutphen
bequeathing half her property to her hus
band, DeWItt Charles Sutphan, and half to
her son, Charles DeWItt Sutphen. Tare
latter is the father of Clinton Joy Sutphen
and Mrs. Gladys Klpllnger. Clinton Joy
Sutphen Is the plaintiff against Joslyn In
the case now at Issue. The attorney referred
to the meetings between C. I. SutDh.n an
Joslyn, and the sale to the latter of the
property and the alleged deal by which
Sutphen was to sus Joslyn for payment
of money for the tract deeded This led
up to the lawsuit by Mr. Estabrook In be
half of Mr. Joslyn. The children of Mrs.
Emily Suphen, it should be added, had
an Interest in the property, because it was
left to husband and son with remainder
to their respective heirs.
First ef all former Judgs J. II. Mecom
ber was called by the nlaiut'ff. He gave
a little testimony which went to show that
his office on the nlntt floor at the New

. H. I Day, a deceased attorney, was
appointed guardian ad litem of the chil

appointment, the plaintiff asserts, was pro
curred by Mr. Estabrook and the further
assertion thst Mr. Day did not try very
hard to protect the children.
Then Judge Mscomber testified thst he
was the attorney of record for Joslyn In
the suit of 1S93; that he did not see Jos
lyn'r, cros bill and answer until Mr. Esta
brook brought it into him, and that he
then signed it.
He attended the hearing, but did not
argue the case. There were present only
Judge Ferguson. Henry D. Estabrook, H.
L. Day, himself and possibly a court re
porter. The defense In the cross bill, con
tinued Judge Macomber, was the rule In
Shelley's case. He himself did not know
then what the court would think of this
rule, but for his own part "regarded it as
nonsensical." The defense did not care to
cross-examine and this ended the session.

realized dream of the Union Pacific Kail
road company after January 1.
After much dissension, dating back ser
eral years. In which James J. Hill and Ed
ward H. Harrlman were opposing factors,
It 1 Is announced that the Union Pacific
trains will run through to Seattle. At
present that railroad only operates Its
through trains as far as Portland.
Through tralna to th coast made up In
Omaha will run to Portland on tho Union
Pacific tracks; from Portland to Siockdele
tbey will run over the Spokane, Portland
Seattle railway; from Stockdale to Ta
coma and Seattle over tha Oregon aV Wash

The Union Paclflo baa terminals both In
Seattle and Tacoma. At tha former place
the trains will enter the new staUon re
cently completed there. The Union Pacific
will now be In a position to handle Its own
side-trip tickets.

chise to r. B. Elce In May, 18M, for a
period of twenty years, and one of tha stip
ulations of the ordinance was that Eloe
should be required to pay tha city of MUoh

cess of $2,400. Eloe made his first payment
in 1901 and for tha succeeding years up to
1904. In 'that year . sold his local ex
change to the Dakota Central company,
which had been granted a franchise to con
duct a long-distance system within and
through tha city, but it carried no tax
clause.
The court holds the city exceeded Its
