living with him again. Mrs. Batten, who
lives In New Jersey, Is suing to abate the
decree of divorce. She assert that Juris
diction was never obtained In the divorce
for the passage of an act prohibiting the

sion during the last year, showing the com.
plaints filed and their disposition together
with reoommendatlona to the legislature
and a financial statement
The report calls attention' to the fact '
that the Sibley law reducing express rateg
16 per cent la being enforced and In this
connection it says:
"It may not be Improper, at thla time to
state that the oommtBslon and the attorney
general were urged In the beginning of this
litigation, to Institute a Urge number of
prosecutions against the express companies
for Individual violations of the Jaw. and
they were bitterly criticised In '-certain
quarters for Choosing what then seemed
to be a more eoneervatlve oours. It
should now be clear to every one that had
the othe plan been followed. It -would
merely have resulted In the commission s
hands being tlrd by a federal injunction,
and It Is exceedingly doubtful whether any
beneficial results would have . been
achieved for the people of the state for
many years, If ever. As the matter stands,
every shipper of express between point
In Nebraska has enjoyed a 13 per cent re
duction In rates since April IB, 190, and
the oompanles have been perpetually en- .

recourse now lies with either the commis

Record of the Tear.
During the year there were 603 Informal
complaints filed of which 456 were disposed
of. There wer thirty-one formal com
plaints filed and there were thirty-two
formal complaints disposed of. At thla
time there are 163 informal and twenty
four formal complaints pending. The in
formal complaints covered a multitude
of subjects and according to the report the
commission has become a elearanoe house
for all differences that exldt between the
people and the common carriers.
The commission reviews in Its report tha
recommendations It made to the late legis
lature and urges that the next legislature
shall specifically define Its authority ovur
common carriers other than railroads;
prohibit false billing of freight; fix the
antl-pasa law; providing for direct appeals
from orders of the commission to the su
preme court except In rate cases; provide
for track connections for grain shippers.
Deputy Maopln's Report.
In his report to the governor. Deputy
Labor Commissioner Maupln speaks highly
of the assistance1 his department has been
given by, the travel. ng men of tha state,
who have acted as deputy hotel Inspect
ors without pay. This was necessary to
secure enforcement of the law, tha legis
lature having failed to make other pro
vision. Deputy Maupln says it has been
physically Impossible for him to fully en
force the lawai to . fire , escapes, because
he cannot personally visit each of the
cities and towns In tha state, and has no
other means for attending to tha work.
So far as hs has been able to do so, he
has endeavored to carry out tha ; pro
visions of the law. Ha urges a more lib
eral appropriation for the eupport of flAt
offlce, and lists his duties under the act
creating the bureau, and provldlog an ap
propriation of $2,500 for tha pay of tha
deputy commissioner ant) on stenographer.
