day and Judges Kstelle and Itedlck, who
are sitting tog-ether, probably will take a
few days before deciding who scores first
blood.

their duty. The real facta, said these
lawyers, are that when the county court
held the tenth and thirteenth clauses of
the will to be Invalid the executors look
an appeal to the district court, thus trying
to get the foundation for the Working
Girls' home established by a higher court.
Denies Right of Objection.
C. J. Smyth denied the right of objection
to an Intervention at this stage of the
proceedings and argued that on trial of
the appeal cases the court could then
dismiss the Intervention If found without
ground. Mr. fcinyih. also, of course, as
serted that his clients who are in law a
number of working girls, are Immediately
and directly Interested.
Pending the outcome of these proceedings
lu district court It la unlikely that Judge
Leslie In county court will act upon the
petition of the executors to Instruct them
how to proceed with the disposition of the
estate with special reference to ths com

on the Rhine. Germany, has written the
Omaha police asking their aid la locating
her son. George Magenhetmer, who was a
resident of Omaha on June 26 of last year.

to locate the missing man If he la In the

Asa Maharg of Memphis wrote the de
partment to the effect his aged father. J.
J. Maharg. who la feeble-minded, had dis
appeared from Ms home at Memphis and
Is believed to have taken 1 B. 4 M. train
for Omaha. The senior Maharg had V30 In
currency and 3.0u0 In drafts In his posses
sion and the son wants the elderly gentle
man picked up If found.

Bonds So Close
the Machines
Will Be Opened
Vote Leads City Attorney to Insist
on Going Behind Face of
Returns.
The city attorney's office Monday .will
ask the dlbtrlet court for an order directing
E. E. E. ftldgeway, custodian of the voting
machines, to open certain machines for the
purpose of having the figures examined as
to the result on the bond voles.
This action will be taken at the Instiga
tion of the city council in an effort to save
the fire engine bonds.
In only three precincts of the whole city
was a majority given against the bonds.
In the Second precinct of the Fifth ward
the vote stood 48 for to 60 against, and In
that precinct Uncle Joe Redman and some
others worked hard to have the bonds
beaten.
In the Fifth precinct of the Second ward
the vote as iclurned by Uia election olTl-
clals stands in favor, 100 aKalnst. In the
Third precinct of the Third ward the re
turn stands iO for, 15 analnst. These are
the two precincts wherein the councilman
uspe t the election offlceis may have cop
ed the figures wrong, and In support of
his belief they point to the Second precinct
of the Third ward, where the result was 1?8
for. with only i against.
If. when the machines are opened, the
figures should prove to have been Incor
rectly copied the fire enijine house bonds
will certainly have carried, and the library
bonds are very likely to pull through.
An adjournment of the council, sitting as
