Held to Be Valid
by the Referee
Judge J. J. Sullivan Finds for the
State and Against Five Ex
press Companies.
The Sibley act of the ,1907 legislator,
known as the express rate law. Is declared
to be constitutional by J. J. Sullivan In an
opinion filed Monday afternoon In federal
court in Omaha and with the Nebraska
supreme court and with the Nebraska
also declares that the rates fixed are rea
sonable. ' Judge Sullivan, acting- as a referee from
the supreme court and a master in chanc
ery of the federal court, has thus given a
finding on a matter which has been of In
terest to all residents of Nebraska ever
since the ligislatura passed the law reduc
ing express rates In this state. The matter
Came to him from both courts, the identical
question being up in a maadamus petition
by the attorney gxneral in the supreme
court and an application for a restraining
order In federal court.
. There are five identical cases, involving
the Adams, American, Wells-Fargo, Pacific
and t'nlted Stales Express companies. Tha
finding hy Judge Sullivan In all Is the
same. In the Adarns case his finding con
cludes: "My conclusions of law are as follows:
"First That the Sibley act. so far as It
affects the business of the Ada,ms Express
company, Is not confiscatory.
"Second That a judgment on Its merits
should be entered in favor ot tha stata and
against the company."
' Judge Sullivan holds that the contract
with tha Burlington road can not ba
pleaded by the Adams company. He says:
"It waa entirely competent for the legisla
ture 10 deal with the items of railroad
transportation as an element In the cost
of carriage and to reduce It If so disposed
to the verge of confiscation. This Item
cannot take sanctuary in a contract be
tween the railroad and the express com
pany." The opinion also says: "The assumption
that it is reasonable cannot be Indulged
In at the axpense of a statute enacted
perhaps on the assumption that it Is unrea
sonable. "Some witnesses for the express com
pany have given their conclusion that tha
rates charged are unreasonable, but I do
not attach much importance to this evi
dence. 1 do not believe that a statute
adopted with all constitutional formalities
can thua be sworn off tha books."

changed?
It has been proposed to make It the Na
tional Corn ana Grain (exposition Instead
of the National Corn Exposition, but the
management frowns on the suggestion.
The assistant secretary of the National
Corn association is sending out letters
calling the Omaha show National Corn
and Grain Exposition and goes further to
call it the National Corn and Grain Ex
position of the National Corn association.
"The name will not be changed this year,'"
said W. O. Paisley, assistant general man
ager. "I believe It a mistake to call the
exposition other than It hss been called
the National Corn exposition.
"L'nder this name 'it has been widely ad
vertised and the minute tha name is
changed the corn show loses much that it
has gained from the work done in Chicago j
two years ago and :n Omaha last year. I
believe the directors would generally ha
opposed to the change and I am quite sure
the change cannot be made this year."
The reference to the corn show as the
National Corn and Grain Exposition of the
National Corn association Is not altogether
popular with Oman an s who have subscribed
the money to support both the corn show
and the largest part of the money to cairy J
on the work of the National Corn associa
tion. This association promised the Na
tional Corn Exposition its moral support
and influence of its membership. But un
der the present arrangement the National
Corn Exposition or business men of Omaha
are putting up the money and wondering
why the other fellows claim the show aa
their "ownest own."

secretaryship recommendation by the grain
dealers' committee and will mnugi; the
clearing house work and the smaller traffic
affairs. The Grain exchange has subscribed
liberally to the Commercial club bureau to
have Mr. McVann continue to handle the
larger traffic affairs.
