One small word In a city ordinance caused
Police Judge Crawford to discharge two
Impute cream cases In police court Fri
day morning. The word was "and."' If It
had been "or,'' the milkmen might have
been fined.1 '
As a result of the discovery of the pres
ent 'wording of the Ordinance. City Prose
cutor Daniel will endeavor to have It ro
vlifd to conform to the original Intention
of the luw, which only assumed Its present
wording by accident when It was changed
and Improved, spine time ago.
According to the present wording of the
ordinance, the kind of cream that Is pro
hibited from sale la that "to which any
foreign substance has been added and con
taining less than 10 per cent butter fat."
Therefore, If a sample of cream happens
to be below the standard, but la naturally
so and has not been adulterated, selling it
unknowingly la not an offense.
According to the former ordinance. If
the cream either hsd been mixed with a
foreign substance or did not have the
necessary amount of butter fat. It was pro
hibited from ssle. The replacing of the
word "or" where "and" now Is, would
change the ordinance to agree with the
Original intention and ault the officials of
tho milk inspector's office snd the police
court.
Demonstrating how he determined the
percentage ,of various constituents In milk
by figuring out the process on Judge Craw
ford's bench In the presence of a num
ber of attorneys and milkmen. Prof.
Charles F. Crowley, city chemist, enlivened
the court proceedings during the hearings
of tho milk cases Friday morning. Before
the cases were discharged, Judge Craw
ford; was glibly talking specific gravities,
analytical methoda ' and percentages of
solids, 'fats and liquids as an expert chem
ist would do ao.
J. M. Jensen of Forty-second and Martha
streiU and L. Laraen of Twenty-eighth
and locust streets, Kast Omaha, were tho
milkmen in court. Larson was represented
by Pardy & Baird. The cases against
them were discharged, aa It was decided
that under the present ordinance they had
committed no offense.
Peter Bouse
is Paralyzed
Stricken During; the Night and Found
Unconscious in His Bed in
Morning.
Peter Bouse, the veteran member of the
Merchants hotel staff, is seriously sick at
his room, 613 South Sixteenth street.
Mr. Bouse waa at his work Thursday and
went home at the usual time In the even
ing. Friday morning when the attendant
in charge of his room went to look after it
he found the door locked. He gained en
trance and found Mr. Bouse In bed and un
conscious. Quickly he notified the hotel snd
physicians were summoned. ' Steve Miller,
night clerk at the Merchants, hastened to
Mr. Bouse's room.
It was found that while he slept Mr.
Bouse had been stricken with paralysis,
leaving him in an uncertain state.
Only a few months ago, Mrs. Bouse died
and Mr. Bouse buried her In Minneapolis,
lila brother, Nick Bouse, one of the vet
erana of the St. Paul police force, la also
seriously ill.
One side of Mr. Bouse's body is com
pletely paralyzed and the doctors are un
able to arouse him from his stupor, so
that little hope Is held out for his re
covery. Mr. Bouse was well liked and has
a host of friends all over the western
country.

Dawes has been selected to succeed J. W.
Blythe as general counsel of the Burling
ton system. His election lias not yet taken
place, but will at th hands of the di

pective employers when he is offered posi
tions in the future. Thursday evening ne
was under' the impression that he had been
hired by several men snd would leave the
city with them on a night train. After he
had 'stood guard over a traveling man's
grips for some time after first loaning $20
to his new employers with which to buy
the tickets, he woke up to the fact that
maybe the men were confidence artists.
He told the police about It and they have
the descriptions of the "employers."

"Roughneck," "terroriser." "outrager"
"lawbreaker" were some of the epl'ets
applied to George Rigby of Thirtieth and
Orand avenue, by Police Judge Crawford,
when the former was tried In court Fri
day morning for having been drunk and
disorderly.
To show that lie meant it, the Judge sen
tenced Kigby to sane ninety days In the
county Jail and fixing his appeal bond at
$500. It Is one of the heaviest sentences
ever given for that offense.
Rigby Is said by the police to be an ex
convict and a troublosome character. He
has beenarrested snd tried In police court
several times before, according to the
records.
"We are going to start a fight right now
to see if the law can be enforced in
Omaha." vigorously declared Judge Craw
ford when the case via submitted to him
after the hearing. "Il l an outrage for this
city to be subjected to the conduct of such
a roughneck. He has been terrorizing people
ever since I've been on the bench."
That even rtigby's attorney did not have
much fmili, in his client or his case, was
shown by the fact that Rigby waa not
placed on the aland and no evidence for
lilin was offered, lue case will be ap
pealed on account of the heavy sentence
for the common charge of drunk and dis
orderly, provided that the necessary bjnd
can " be furnished. Rigby'a brother says
that a bond of lo0 may not be within their
reach.
Rigby lives with his widowed mother,
who conducts a small store in the nortli
part of the city, near Fort Omaha.
Before being arretted Wednesday night
by Detectives Ferris and Dunn, the man
threw a brick through a window at the
home of Mrs. Floods, with whom he once
went to school and who has been made
the object of his abuse for some time, ac
cording to her own testimony. She Uvea

Rigby also hired a horte and buggy from
the Palace livery stables and abused the
animal and a recked the buggy while drunk
that night.
When testimony to that effect was of
fered in police court Friday morning, he
sat smiling enjoying the hearing and did
not sober down until the Judge pronounced
sentence.
Burglar Chased
by Policeman
Negro Thief Who is Seen Emerging
from Home Beats Officer in
the Race.
A negro burglar was given a hot and
lively chase in the vicinity of Curtis Turner
park about J:30 o'clock Friday morning by
Patrolman Cunningham before the prowler
made his escape in the shadows of the
park.
The home of Dr. C. T. Richardson, 37
Chicago street, was entered through a win
dow and $1 . removed from the doctor's
trousers pocket. As the thief was leaving
the place, the policeman saw him and the
chase began. Two shots were fired and the
neighbors awoke, but the burglar got away.
The police have his description and all
officers have been instructed to arrest suspects.

but could not touch it. The money was
taken from Mm at police station and I

stolen from Andrew Carey. The court will
appoint an attorney for him.

Mrs. Bojo Wlalsavljoick appeared bofoie
Judge W. H. Munger In the United States
district court Friday morning and entered
a plea of guilty to the charge of having
in her possession and trying to pass one
of the 1100 bank notes of the defunct Mer
chants and Planters hank of Savannah. On.
It was shown that the woman was Ignorant
of the character of the note, supposing
it to be genuine, as It had been previously
passed upon her.
In consideration of her ignorance, sen
tence was suspended In her case and she
was released upon her own recognizance.
She operates a Greek hoarding house in
the southeast part of Omaha.
