whether or hoping that he might bneflt
hy Connor's will, the matter never troubled
him.
Rlshop Scanned, who was on the utand
for exactly an hour, proved a good witness
for the proponent. He was called princi
pally to tratlfy ax to the date of his con
versation at Thirteenth and Farnam
street with Connor, when the latter asked
Mm why he did not attend Connor'! wife's
funeral, and which the respondents have
testified occurred In the latter part off
Ma', after the will was drawn. The bishop
wore It was May 1. lie could remember
nothing of the conversation except that
"Connor asked me why I did not attend
Ms wife's funeral and I answered that I
had not been asked.
"When Connor left and after he had
gone a few feet, turned and said something
which I do not remember, though he dis
played much energy. I remember his man
ner, but not his words."
On cross-examination on this point Judge
Sulllvin presHed the witness hard, endeav
oring to show that Connor was angry or
hostile. Bishop Scannell would not, say
more, however, than that Cononr's manner
was energetic.
'?fo was un usually energetic?" asked the
attorney.
"Not unusual for him, but what would
have been energetic for another man."
Much of the testimony centered around
the terms of the will with regard to the
nature of the religion of the board of trus
tees for the parochial schools.
"You know," asked Judge Sullivan, "that
in the event of death or resignation of one
or more trustees a majority of the board
might become infidels or Protestants?"
"Yes."
"You are willing to accept tho bequest
on such terms?"
"Yes, because I could put a stop to It If
the board were to run counter to what was
right."
Over, this questions and answers were
numerous and Judge Sullivan several
times made use of the term '"achieving by
Indirection," a phrase which the witness
did not relish. Tills was the only part of
the experience which apparently the bishop
did not enjoy, and during the questions
about the time he called on Connor in hla
office and asked him for a subscription,

ment. "You left abruptly when Connor re
fused?" "I went away."
"There was a feeling of hostility between
you?"
"No, but I was not as cordial as I might
have been If he toad given me 110,0u0."
The bishop laughed at his own answer.
An earlier part of tils testimony devel
oped the fact that the "Joseph A. Connor
Seminary" which Connor proposed to en
dow. Connor Intended as a sort of "non
sfefarlan theological seminary, admitting
students." said the bishop, "of any religion
or no religion. 1 told hltn it was Impossi
ble." Another quostlon he was asked was as
follows:
"Do you know any precedent whereby
Catholic parochial schools are controlled
by non-Catholics or Infidels?"
"Yea, In Europe."
"in Franco?"
"Yes."

Young of 2530 North Twenty-fifth street
when he was fined 16 and costs in police
court Wednesday for assaulting his son-in-law,
Mallory Morgan, because he called
on his lfe In violation of a court order
to stand until she obtains hsr divorce.
"Better pay 1t than go to the county Jail,"
advised his attorney. S. A. Searle.

Young went to Jail and had been there
but a little while when along came a par
don Issued by Mayor Dahlman. The mayor
had been advised that Judge Crawford In
polite court admitted Morgan violated the
court order and Dahlman didn't believe

law.

The trains will be run from St. Louis to
Cheyenne to connect with the Ixis Angeles

John Fry, superintendent of the Evangel

Quakers and friends enough In Omaha

services, perhaps build a church for the
new organization.
