Jan. 5.-The statement Is made today on authority that notwith standing the refusal of the t'nlted States supreme court to rrant a writ of certiorari In the case, of the Standard Oil company yesterday, the Department of Justice will at once proceed with the trial of the numerous other cases pending; In different sections either against the Standard Oil company for receiving rebates or against the railroads for granting them to the Standard Oil company. Involving the same questions, and which have been awaiting the action of the supreme court on the application for the writ. These Include the cases of the northern district of Illinois and suits In the western district of Tennessee, the southern district of Cali fornia and the western district of New York. Will Press for Hew Trial. The effect of the refusal by the supreme court to take and review the Standard Oil company case on certiorari Is to leave that case resting upon the Judgment of the circuit court of appeals and the natural tesult will be that It will go back to the trial court for a new trial In accordance with the mandate of the circuit court of appeals. It Is understood that the govern ment Is ready and will press for a prompt trial and It is supposed that the re-trial, liks the original trial, will proceed before Judge Landls as the trial Judge, although there will be a new Jury. It Is stated that since the supreme court gives no reasons for Its denial of an ap plication for certiorari, It la Impossible to surmise what ressons were In the mind of the court and It Is well understood that the denial of a writ Is not to be taken as In dicating any Impression of the court on the merits of a case. If the result of a new trial were the acquittal of the Standard Oil company of Indiana, that would be the end of the matter. If, on the other hand, It should be convicted again, the case would then be taken In the regular courss on its appeal to the circuit court of ap peals and ultimately to the supreme court. Bla- riae Still Possible. CHICAQO, Jan. 6. "The Standard Oil company Is not yet out of the woods." With these words United States District Attorney Sims today made his first com ment on yesterday's ruling of the supremo court which prevents the government from collecting Judge Landls' famous $29 240,000 fine. "The big fine case will be redocketed within a fjw days," said Mr. Sims, "and may be on trial within two weeks." The district attorney explained that even by fining the Standard OH company on a basis of settlements for freights.
