William O. McMannla. driver of wagon
number 23 of tha Merchant' Express com
pany, waa almost Instantly killed about
11:15 Friday morning by being caught and
crushed between two frrlght cars. In the
Northwestern yards, between Cuming and
Burt street. Just east of Fourteenth.
The first Intimation of anything out of
the way was when Charles Evans, foreman
of the Northwestern freight depot and one
of the switching crew of the engine, saw
McMannls fall back from between th two
car after th engine had bumped Into the
string of car, which were standing on the
trark. He evidently had attempted to pas
between the two car which, were but a
few feet apart.
When picked up McMannls" wa uncon
scious and th police ambulance was called,
but th man died enrout to th Omaha
General hospital.
An examination of the body Indicated that
McMannis had been ciuxiit between the

Omaha factory will be greater than at

wider and have a twenty-foot basement,
which was not In the original specifications.
Beside this the office will be made larger
and the foundry building and warehouse
buildings may also be enlarged.
Mr. Howard arrived Friday morning and
opened bids for tha construction of the
new stove plant at Ralston. He submitted
four sets of plan and ha not yet de
cided between cement and brick construc
tion. He said contract would be let within
a week.

their spur track and th main siding for
th terminals will be laid before froet 1 In

stov factory and car shops. They alae

will begin the construction of a street car

J. S. C00LEY IS VINDICATED
"Jedge" Come Clear of the Charge

"Judge" Julius S. Cooley wss vindicated
before Judge Sears of the district court
Friday , morning and came clear of the
charge preferred against him uy a colored
client named Landing E. Jackson. This
dispels the cloud, handing over the right of
Cooley to continue his legal practice and
puts to rest the proposed disbarment pro
ceedings. Mr.. Cooley quarreled, with the pros
pective client. Landing E. Jackson, some
months ago, and aa a result Jackson,
brought up to be tried, accused the lawyer
of having offered to use his influence to
get him a light sentence. The charge was
ordered Investigated and testimony from
various source was secured which proved
that Cooley had asked a fee of lloa for his
professional services, which he failed to
get, but not that he had offered to In
fluence the bench. The statement of
Jackson was the only foundation for that
suspicion and it was dismissed . as not
established.
In giving his opinion Judge Sears re
marked that the 3100 asked was, of course,
not an exorbitant fee when honestly asked,
and he found grounds for no reproof except
a warning that all business between at
torney and client should be so open and
above board that no misunderstanding
could possibly result.

vegetables In short measure. The peddler
wa arreated once before, but got off on a
technicality. .Mr. Pegg says thai he hope
this time to make the. accusation stick,
and through the arrest and conviction of
Haullett set an example to other peddler
who do not give full weight or measure.
