Judge rifdlek took under advisement
Thursday morning the caae of the North'
western railway against the city and Doug-
la county, which arose from a dispute
over the taxing of the freight depot on
North Fourteenth street. Taxes amounting
to about were levied on this prop
erty tor 1X7 and 1S06. which the railroad
company asserts were unjust, a the prop
erty was a depot site and therefore exempt
from the city and county taxes.
llr. Dunn, representing the city and
air. Ellick for the county, have contended
that as long as the depot was not actually
built on the ground It could not properly
be called a depot site. Mr. C. C. Wright
for th Northwestern argued that as It was
originally slated that the ground would
be used for a depot and th building was
begun In good faith a soon as possible
that It ha been legally a depot all from
the beginning.
