The road as planned with be a water
grade road and be especially available for
freight purposes whereby the present road
to the northwest lias some heavy grades.
This road was surveyed over a yesr ago.
but all work was stopped when the finsn
elal trouble arose Inst fall. The Burlington
now has a line to Guernsey and has a lino
tartrd from North Platte to Bridgeport on
which work may le resumed at any tlmo.

It will make all the Big Horn Basin coun
try tributary to Denver, whereas that coun
try Is now looked upon as Omaha territory,
because of the better railroad facilities to
Omaha.
The building of this road Is one of the
principal enterprises for which the Burling
ton recently filed mortgages for t30.O0O.000.
It Is purposed to spend (27,000,000 in the
construction work and to push It rapidly
to completion. The survey has already
been completed.
The government Is now spending several
millions of dollars In Irrigating the terri
tory adjacent to the Big Horn river.
There are about l.MUWO acres of land to
be supplied with water at once, partly
by the government, and partly by private
enterprises.

Although the complete dorfsion of the
Interstate Commerce commlcKlcn In regard
to the Missouri River Jobbers' association
dry goods case Is not at hand It has been
learned that the commission has ordered
a reduction of 9 cents per 100 pounds in
the first class rate from the Mississippi
to Missouri river, or In other words, has
reduced the present rote from 60 cents to
SI cents per 100 pounds. This reduction,
however, only applies on proportional
through rates from the Atlnntlc seaboard
and other eastern points to the Missouri
river. This means that no reduction will
be made locally from St. Loais or locally
from Chloago.
The same reduction of 15 per cent Is
made on classes 1, 2, 3, 4 and 5, but does
ot apply to the lettered classes a, b, c, d.
and e.
For Western Classifications.
Commissioner J. M. O-lld of the Com
mercial club left last evening for
Manltou. Colo., to attend a meeting of the
subcommittee and later a meeting of the
western classification committee. The
meeting is a semi-annual conference and
the docket has 493 subjects on It.
Among the most Important subjects to
be dlscursed Is the minimum carload
weights. A proposition has been made to
take the minimum weight on freight rated
third class or higher. JW.fxio pounds and on
freight lower than third claps ai.Ouo pounds
and the committee will consider proposed
changes In minimum on a lurge number
of specific commodities.
A rule will be proposed requiring peti
tions for changes In the. classification to
be filed within forty-five days In advance
of action Instead of thirty days, as Is re
quired at present, except when, by unani
mous consent the ruin shall be waived.
Another subject docketed for considera
tion la a proposed requirement for stronger
and better packages. The subject of get
ting better revenues for perishable freight
will also be diseased. It Is proposed to
amend existing rulra so as to rrovide that
In order to secure the carload rate the
quantity of freight required under the rules
must be delivered at one forwarding sta
tion In one working day by one consignee
for one consignor and destination, except
that where freight Is loaded In cars by
the consignor it will be subject to the
car service rules and charges of the for
warding railroad.

Holding a corporation cannot be licensed
to sell liquor In Nebraska, Judge Konnely
Monday afternoon sustained the remon
strance against tho IhsuIuk of a license at
KruK park and held the license voted by
the r.cnsou village board was Illegal. This
leaves the park without a permit to sell
liquor until a new license can be secured
or the case decided by tho supreme court.
The decision of Judge Kennedy U of
sweeping Importance, as It has I t en the
custom In some placts for llceru'.'.g b ard3
to Issue permits to corporations, imunlly
breweries or distilleries. Judge Kennedy's
decision. If sustained by the suii"me court,
would make all such permits Invalid. The
case probably will be appealed to tho su
preme court.
The Nebraska statutes provide that a
license can be issued only to a ' man" of
respectable character and standing, and a
resident of the state. Judge Kennedy
holds that a corporation Is not a man of
respectable character and standing and
hence cannot hold a license.
The decision Is in the uppealed case from
Benson. The Western Amusement com
pany, a corporation, applied for license to
sell liquor and after a fight, the Uenson
village council voted to grunt the permit.
The rernonrtrators appealed to the district
court. Several other questions were raised
but Judge Kennedy did not decide these,
as hla holding on the first point madu it
unnecessary.
The case probably will be carried to the
supreme court aa the point has never been
passed on by that tribunal. Judge Cor
coran at Heatings, some Urn ago, held that
a corporation could hold a license, ao there
are two conflicting oplntona by district
Judges, and the only way to settle the
question Is by appeal.
