TO TTIE OMAHA 1M1LY HEE: Ti DAY. '.TTvTL ' 2fV : m.. "Sill.1 rlOREE -POINTS FOR APPEAL i Attorney for T7atT Board Trepare to , , . . "Carry Case EigheT. ' 05 TJSAOTOTTS ArFRAISAL CsrteatlM Fat rrh at , l Aimn, Srt hf M Jrl7 Deflate . rrie tPla. rim miS Jrtrtn I Webster,' attorney for the Water finard. haa prepared to carry the appraise ment ease nf the Omiht Water company to th supreme cotir.t. th petition for a writ of cfttl'orrl having been drawn and Is now In th bands of th printer.. Tha peti tion covers about 10 typewritten pa-ea and presents araunienta on thre errors which the attorneya for tha Omaha Water Board claim were made In tha recent de cision which upheld the appralaement. The first contention Is that tha award la void.' Kir-cause rot concurred In by three appraisers. ' On thia point tha petKton re cltea: ' "Tha contract' In the case at bar, by its !na-UB(re, and by the Interpreta tion put upon It '-by everybody connected w'.th thla transaction, contemplated that tha valuation ahould be ascertained by tha Joint concurrence ofi'the three appraiaera, and alt parties acted on that theory until tha moment when It was finally determined that tha three appraiaera could not a free, whereupon for the first time, two apprais ers assumed to make an award. . Claim of (he "Water Boar. '"Tha law of the case la universal in both England and America, that a contract worded as lb tha case at bar, requires tha Joint concurrence of all the appraisers and that, an award by two la void. ."Tha. atatement by the court 4 hat It was not Intended that the appraiser selected by tha olty or tha one aelected by tha company might causa tha appraisal to miscarry by i-efssal to join In tha valuation found by tha other two. la not justified by any Ian Ztiasa in tha contract. On tha other hand, I we jntg-ht-aitirceet that the purpose and in tention of tha contract waa that all three should, concur jn, the a.ward so. as to lnsur a fair valuation and to prevent tha water company securing an excessive and un reasonable valuation through the voice of a majority of tha appraisers." ' In tha Omaha Water Company against tha City of. Omaha C7 Fed. 1) tha same court held that tha same contract between tha city of Omaha and the water company was' a matter of private contract aa distinct from one of public concern. . Tha earn court now holds on the election to purchasa that the same contract between the city of Omaha and tha water company Is r. public contract and of a public nature a distinct from a contract between Individuals or a private corporation. Certainly the city of Omaha, In dealing with the writer company ha 'tha right to have the contract receive the same interpretation In Us different lltl r at Ions with the water company. It cannot be that tha aaane contract, in one law aujt shall be ruled to be -a private contract for the purpose of nulllfyirvs the action of tha city government In- regulating meter rates and In tha rent suit shall be held to be a public contract for tha purpose of nullify ing a subsequent action by tha same city government.' i T Allegation of Mlaeaaaaet. The second reason, given ' (n tha alleged misconduct of tha board of appraiaera in making a private examination of tha books of the Omaha Water company In Cincin nati a year after the case waa cloaed and . tha arguments made. by tha partlea In tha case wsre submitted. On thla point tha . petition says: "Tha award ia void, bees use the appraia era concluded the formal hearing of testi mony and tha arm-merits of attorneya for tha respective. parties on tha 31st day of De cember, 1HH, and afterwarda in, February. 1HC6, :a the city of Cincinnati, privately and against the protest of the city of Omaha, received and aecretly examined, ex parts. the hooka of the water acmp&ny, and tinder an understanding that tha city of Omaha Should not be permitted to aea or know tha contents of said books. The queetlon to be considered Involves a moral principle. Tha incident complained of did not give tha city a square deal." The third reason gtven Is that thara la no power given to tha city of Omaha to appropriate money, levy a tax or Issue bonds to pay the purchase price for tha water company a property la South Omaha, tast Omaha or Dundee, (Ml I Ml LN ssMssx. i i If 13 3 r3"r3.j :n"EJ a a. n.n u ;c:n d is:H"'B3rii':B'"'0 n n fru . . r, .. al rniT "T lit UiW' Ion Jesrasl Tsttera I U 1 Jy lliLL wits U)t Quarterly Style Beak, at...
