While running across the street at Six
teenth and Farnam streets about 8 a. m.
Monday, Andrew Sawyer, who resides at 431
Martha street was struck by a large red
automobile running east on Farnam street
and rolled several feet into the gutter from
the force of the Impact
Mr. Sawyer sustained pnly a few minor
brulsea. He was struck In the aid by the
steps of the machine. The occupants of
the automobile slowed down after the col
lision, turned around to se him lying la
the street and then put on all power and
got away from the seen of the' accident
with all possible hast, not even waiting to
ascertain tf Sawyer's Injurlea would prove
serious.
Mr. Sawyer asserted that the automobile
was traveling at a high rate of speed after
; coming down the hill from Seventeenth
street and the driver did not blow Ms horn
In warning. The number of the machine
as taken by Mr. Sawyer was 856 and b
will file a complaint In police court when
the Identity of the driver I ascertained.

Controversy.
The esse brought by M. J. Greevy. backed
by Dr. Oe-rge L. Miller. In bhlf of th
freedom of dogs from the muxxle may have
a more far-reaching effect than the author
Intended. The caji waa passed until Fri
day In Judge Sears' court Monday morning
nd It will come up before Judge Redlck,
who Is now In Burt county.
The crux of the suit Is the action of the
voters on the Initiative and referendum law
which was submitted to them last fall,
long with a franchise for th Independent
Telephone company nd a couple of bond
propositions. According to the return all
of the propositions carried. The telephone
company Is now at work under Its franchise
and th b nd authorised by the vote havn
been Issued and the money spent: but for
getfulness attacked the city authorities on
the subject of the Initiative and referen
dum. Even city officials failed to realli
that It ws a part of the laws of the city.
Ordinances were drawn and passed by th
present council as In the days before tha
people had spoken on the subject and a bar
majority was considered as sufficient to
enact an ordinance, even with the enter
gency clause.
Greevy Snre of Success.
Now comes Mr. Greevy and says:
Our contention will win. It was the city
which sked f'cr a continuance. The statu
of the dog ordinance under the terms of
the Initiative and referendum law struck ro
tin peculiar one night and the next morn
ing I consulted with lawyer and among
others with John O. Teler. the author of
the Initiative nd referendum law. They
greed with me and this Is to be the strong
point of the suit. In order to be binding
s n emergency law the ordinance must be
passed by unanimous vote. The dog ordi
nance received but nine of twelve votes,
and It surely did not rs wl,h ,h emer
gency clause. The clause was In the bill
paased, and my understanding Is that with
this clause adopted by less than unanlmou
vote the entire bill is void.
"If thl contention 1 ustalned there will
be few ordinances pased since last fall
which will stand in court If suit Is brought
to set them aside. Some of these ordi
nance are exceedingly Important and ome
people may be sorry the dog ordinance ws
attempted before they get through with
the matter."

the Missouri, the headquarters of the reg
lment and three squadron will be stationed
at Fort Robinson snd Troops G and H will
go to Fort D. A. RubspII. Wyoming.
The Sixth regiment of field artillery
(horse) Is to be stationed at Fort Riley.
Under th new arrangement of concen
trating the artillery batteries Into regiment
each regiment will now consist of six bat
teries. The former Twenty-first battery of
field artillery la now absorbed into the new
Sixth regiment and will be transferred from
Fort Sheridan. III., to Fort Riley. .
The new Fifth regiment artillery (horse)
will be stationed at Fort Leavenworth, but
one' battalion will be detailed for duty In
the Philippine.
Th Second regiment field artillery (moun
tain) has been assigned to station at Fort
D. A. Russell, but one battery Is detailed
for duty In Cuba.
The Twelfth and Nineteenth batterieg
field artillery, now at Fort D. A. Russell,
will be sent to Fort Sill, Oklahoma.
