The suit for damages was brought by the owners of the Orinoco. According to the reports submitted to the captain of the port of Cherbourg by the commander of the Kalsor Wllhelm der Grosse, the German vessel was rounding the head of the dyke at Cherbourg, when its captain perceived the Orinoco and "gave two blasts of his whistle as a signal for the Orinoco to keep to starboard."
