SECOND CHAPTER AND DRAW
Extended Lesral Flaht Over Ba of
Cexeeat Ceaaee Oat Evea
Chapter No. I In an extended legal fight
oyer a bast of cement and a principle was
finished yesterday In the district court,
when Judge Estelle 'entered Judgment In
favor of the defendants In the famous
case Of Ira L, Van Horn against Sander
land Bros, and the Omaha Coal and Cake
company. This make one victory each for
plaintiff and defendants to date. Unless
the plaintiff decides to quit the suprems
court will have to decide the matter.
It was during the strike In Omaha in
1908 that the case started. Van Horn, who
Is a carpenter.' filed an affidavit In which
he set forth that he had gone to tbe de
fendants' place of bualness and offered to
tender SIM for one sack of hardwall plas
ter and that the defendanta refused to de
liver th same to him, though they had It
In their possession and though It waa a
public utUlty.
Hs charged the defendants with entering
Into a conspiracy to fix the price of lime
and cement, to prevent competition, to dla
crimirsvte against labor unions' and to
force the co-operation of people needing
these commodities In order to break the
strike.
On June S, Wi, he secured a writ of re
plevin for the sack of hardwall plaster
and it waa secured for him by a constable.
The decision waa In favor of the plaintiff.
It waa found that by tendering- the 11.60
for the hardwall cement he acquired a spe
cial ownership In it and the defendants had
no right to withhold it from him. The
plathUfTa damage waa fixed at I cents.
