coal lands In Wyoming, nor has he been
directed to proceed against that railway
company and others for violation of the
Interstate comrnerce laws as brought out
by the recent Investigation held by the
Interstate Commerce commission In Omaha.

The Nebraska and Iowa Retail Harness
Manufacturers and Dealers' Protective as
sociation met Wednesday afternoon and
Thursday morning at' the Murray hotel,
perfecting the organisation on which pre
liminary steps were taken a year ago.
The constitution waa remodeled and offi
cer were elected a follow: President,
A. Anderson of Omaha; vice president,
Harry II. Bprlnkel of Elliott, la.: secre
tary, Henry Herxog of Omaha; treasurer,
P, H. Toner of South Omaha. These, with
three others, comprise the executive board
of the association.
Resolutions were passed calling on mem
ber not to trade with manufacturer or
jobbers who do any retail business. Manu
facturers who sell to mall order houses
were tabooed by the passage of another
resolution.
J. B. Conlngham of Omaha, state organ
iser of the Nebraska Retail Merchants'
association, addressed the convention on
the need of organisation In all line of
business.
. The time and place of the next conven
tion will be decided by the executive
board.
URE AND KENNARD LAID UP
County Commissioners Are Nnrslag
Bralsea Sustained In n Runaway
Wednesday Afternoon.'
County Commissioner Kennard I laid up
at home with a . sore leg and a bruised
body anil Commissioner Ure is nursing a
aore ankle a the result of an exciting
runaway Wednesday afternoon at the farm
of'Eggert Otte, about five miles south of
Benson. The commissioners were out view
ing roads, Solomon and Tralnor having one
rig and Kennard and Vre another. The
latter were Just driving Into the barn
yard when the horses started, to run. Tho
wagon struck the buggy Solomon and
Tralnor had been using, and the Impact
threw both Kennard and Ure out of the
eat. They landed together in a heap and
Ure rolled over Kennard several time be
fore, they could top themselves. When h
picked himself up Vre still had his pipe
gripped between hi teeth.
Mr. Kennard' Injuries were more serious
than those of Mr. Ure. He tried to watch
tha parade Wednesday night, but had to
be taken home in a carriage. Thursday he
wa reported better. The rear wheels of
8olomon's vehicle were tern off, but no
other damage done.

'The right of the Chicago Great Western
to condemn for trackage purpose a atrip
of ground belonging to the Omaha Belt
line was upheld by Judge Jroup Thurs
day afternoon. Judge Troup dissolved the
restraining order granted sometime ago
to the Bolt Line, enjoining the Great West
ern and county court authorities from
going on with condemnation proceedings.
This heave the Great .Western free to
enquire the property. ,
One of the point decided by the court
was that one railroad corporation could
acquire front another by condemnation
prove property nut in actual use for rail
read purposes. The right of the road to
acquire .the property under it Iowa
charter waa also upheld.
The land in controversy is a V-shaped
piooa at tha Intersection of the Burlington
and Union Pacific. The Great Western
deelrea to build a connecting line between
tha - two road In order that It may ex
bang grain business with the Burlington.

location, one In the Board of Trad build

ing, but tha present lease will not be out
