serve a meal to Mr; and Mra. George
Young, colored, of the city, were yester
day held by Justice Gardner to await tha
action of the grand Jury, their bonds. being
placed at 1300 each, which they furnished.
The charge against K. ;W.Uon, , a waiter
em-ployed In the restaurant, was dismissed.
It .being shown fnat he wsi merely nn
employe a'nd was acting under orders from

Monday when the esse was called the .de
fendants demanded a Jury and one was Im
panelled, but ajfter the Arrorneyg had ,made j
their openlnt; statements .the hearing was
continued until Tuesday afternoon. When
the Hearlnf Was resumed yete"rday counsel
for the Complaintrig witnesses' discovered
th alleged offense was an Indictable -nile-demeanor
and that the defendants under
the circumstances, were not entitled ' to a
Jury, it being for the court alone to deter
mine whether thore was sufficient evldenco
to warrant binding them over to the grand
Jury.
When the attention of Justice Gardiner

m lived '. the 'vjury and proceeded -with the
hearing-.' The evlde'rice wits somewhat con
flicting. That of the waller, Watson,' wia
to the effect, that he;, had told the conw,
plalnants they couldjnot be served on ac
count of their color., Evidence was offered
by the defense that the .reason Mr. and
Mrs. Young had been refused service wsa
because aine was over, '"but this particular
te-ttlmony waa somewhat upset by another
witness, who testified than ah . offer to
serve the Young party In the kitchen or
a "back dining; room" had been made.
At the close of the hearing Justice
Gardiner annonnred thaifthe evidence left
little douht ,in' "ils ' mind, but that . the
complainants had been refused service r-n
account of their color end that belnf the
case. It was one for the-grand Jury to
wrestle with. The case has, attracted con
siderable attention and the court room waa
crowded.

ises was made, but the fugitive was not

The city council met yesterday afternoon
and assessed up the cost of the recently
constructed paving on South Ninth "street,
between First and Seventh avenue. It waa
found that the city would have to bear
11,606 of Jhe assessment, which will have to
be paid out of the general -Improvement
fund. ....
The council also met. as a committee of
the whole and went to Falrvlew avenue,
where, after looking the (round over, de
cided to recommend that the paving, at. the
terminus of the street opposite the end
of two lots be out out of the contract.
Another meeting of tha committee of tha
whole will be held Friday afternoon, but
there will be no meeting of the council
until the regular session, which - occur
