The said grantee shall at all times protect snd save harmless the said City of Omaha from all damags and loss from, or arising out of, or reason of ths construction or operation of, said telephone system, or by reason of any lnfringemanl of any patent upon any artlole or system used in the construction of said tslephons and conduit system, or from any damagi arising from claims by reason or the neg lisjence of said grantee, his servants or em ployes, whether In the construction, use or operstlon of ssld system or any part thereof, and said grantee hereby agrea to render to his patrons at all times such serv ice sa it Is practicable to secure through the advance In technical science.
